Teleflex sales rep misclassification $160K collective action settlement

Teleflex agreed to a $160,000 collective action lawsuit settlement to resolve claims that it misclassified its sales representatives as exempt during initial training. 

The settlement benefits associate sales representatives, senior sales representatives, account managers and territory managers who engaged in Anesthesia and Emergency Medicine Onboarding training for Teleflex between April 5, 2020, and April 5, 2023.

According to the collective action lawsuit, Teleflex misclassified its Anesthesia and Emergency Medicine sales representatives as exempt from overtime during their initial training periods. This allegedly denied the workers overtime wages and other benefits.

Teleflex is a medical technology provider whose sales representatives sell various medical devices for anesthesia, emergency medicine and other solutions. 

Teleflex hasn’t admitted any wrongdoing but agreed to pay $160,000 to resolve the collective action lawsuit.

Under the terms of the settlement, class members can receive an equal share of the net settlement fund. No payment estimates are available on the settlement website. 

There is no exclusion or objection deadline for this collective action lawsuit.

There is no final approval hearing scheduled for the settlement.

In order to receive settlement benefits, class members must submit a valid claim form by Oct. 2, 2023.
