  • The settlement administrator emailed Notifications of Deficiency to Class Members of Group 1 and claimants in Group 2 on June 16, 2021.
  • If you are a member of Group 1 and received a Final Notification of Deficiency via email, the administrator requires your mailing address in order to send you a payment. Please provide your mailing address on a mailing address form using the Claim ID and PIN from your email. The form can also be downloaded here. If the administrator receives your timely form, they will mail you a check.
  • If you prefer an electronic payment or would like to donate your payment to Fisher Center for Alzheimer’s Research Foundation charity, you must submit a payment selection form using the Claim ID and PIN from your Notification of Deficiency email.
  • Group 2 claimants received a Notification of Deficiency via email if their cellphone on their Claim Form did not match any phone number in A Place for Mom’s notice database. If you want to be eligible for compensation, your claim must use a cellphone number at which where you received a non-emergency call from or on behalf of A Place for Mom between Aug. 7, 2013, and Aug. 15, 2019, that matches the defendant’s records. To participate in the settlement, resubmit up to three such cell numbers here.
  • Failure to respond with this information and your Claim ID by July 16, 2021, will result in your Claim being rejected.
  • Payments will be made after deficiencies are resolved.

A Place for Mom class action lawsuit has been resolved with a $6 million settlement providing payments for consumers who received an unwanted call from the company.

The settlement benefits individuals who received a call from A Place for Mom Inc. between Aug. 7, 2013, and Aug. 15, 2019.

There are two groups of Class Members in the settlement: Group 1 Class Members who could be identified from the companies records and Group 2 Class Members who could not be identified through these records.

Around 56,000 Group 1 Class Members were reportedly identified through “locate.aplaceformom.com” and variations of that website. Around 3 million Group 2 Class Members were reportedly identified through other sources such as incoming telephone calls and other websites.

Plaintiffs in the A Place for Mom TCPA class action lawsuit claimed that the company violated the Telephone Consumer Protection Act by calling consumers without their consent. According to the plaintiffs, these calls entitled consumers to monetary relief under the law.

TCPA is a federal law that prohibits unsolicited calls, texts, and faxes to consumers who hadn’t provided their prior, express written consent. Failure to comply with the TCPA may entitle consumers to up to $1,500 in damages per violation – meaning that repeated calls could add up to thousands of dollars in owed damages.

The company has not admitted any wrongdoing in the A Place for Mom TCPA class action lawsuit, but has agreed to resolve the claims against them in a $6 million settlement.

A Place for Mom maintains that it “has never engaged in cold calling or robocalls.” The defendant also noted in a statement to McKnight’s Senior Living that A Place for Mom TCPA class action settlement “will allow APFM to keep its focus where it belongs, on making the lives of our families and customers better, easier and more successful.”

Exact payments under the A Place for Mom TCPA class action settlement will depend on the total number of Group 1 Class Members who can be located and the total number of Group 2 Class Members who file a valid claim form. However, Class counsel estimates that payments will be in the range of $34.

Group 2 Class Members must submit a claim form on the settlement website. Group 1 Class Members are not required to file a claim form but are required to submit their updated address and payment information on the settlement website. Both submissions are due by Sept. 15, 2020.

The deadline for exclusion and objection is Aug. 20, 2020. The final approval hearing for the settlement is scheduled for Oct. 1, 2020.

Individuals who received a call from A Place for Mom Inc. between Aug. 7, 2013 and Aug. 15, 2019. Group 1 Class Members could be identified from the companies records but Group 2 Class Members could not be identified through these records.
