Systems East agreed to a class action settlement resolving claims it failed to prevent a 2023 data security incident that exposed the personal information of individuals who used its online payment platforms.

The Systems East settlement benefits individuals who received a data breach notification from Systems East on or around Nov. 16, 2023.

The Systems East data breach class action lawsuit alleges the company’s negligence allowed a data security incident to occur, which exposed the personal information of its customers.

Plaintiffs in the case argue Systems East should have implemented reasonable cybersecurity protections and other measures to prevent or mitigate the 2023 breach.

Systems East is a payment platform that provides collections, finances, payroll and online payment services.

Systems East hasn’t admitted any wrongdoing but agreed to pay an undisclosed sum to resolve the data breach class action lawsuit.

Under the terms of the Systems East settlement, class members can receive either a pro rata payment or up to $8,000 in reimbursement of out-of-pocket losses and damages associated with the data breach.

It is estimated that each claimant who chooses the pro rata payment option will receive around $75, though actual payments will be higher or lower. The pro rata payment amounts will vary depending on the number of claims filed and the amount left in the settlement fund after reimbursement claims are paid. These payments are available to all class members regardless of their experiences following the data breach, and no proof of damages is required to claim the pro rata payment.

For individuals who incurred documented out-of-pocket losses linked to the Systems East data breach, the settlement provides up to $8,000 in reimbursement for these losses. Out-of-pocket losses covered by the settlement may include damages associated with identity theft or fraud, the costs of accessing or freezing credit reports, the cost of credit monitoring or other mitigative costs and more.

In addition to providing monetary payments, Systems East agreed to pay for, implement and continue specified information security measures as part of the settlement.

The exclusion and objection deadline for this settlement is Nov. 15, 2024.

The final approval hearing is scheduled for Dec. 4, 2024.

The claim form deadline is Nov. 15, 2024.
