UPDATE:

  • This class action settlement is paying out as of April 14, 2023.
  • Congratulations to everyone who filed a claim and got paid!

Consumers who were prescribed Suboxone could benefit from a $500,000 Federal Trade Commission (FTC) settlement over false advertising and antitrust violations.

The settlement benefits consumers who were prescribed Suboxone oral film between March 1, 2013, and Feb. 28, 2019.

Suboxone is a medication used to treat opioid addiction, according to Drugs.com. The medication comes in a tablet and film form.

According to the FTC, Reckitt Benckiser and Indivior conspired together to maximize Suboxone profits at the expense of consumers. In an attempt to convince more patients to take their branded medication, the companies allegedly deceived patients and doctors with claims that the film version of Suboxone was safer than tablet versions.

To secure their profits from this alleged false advertising, Reckitt Benckiser and Indivior suppressed generic competition by filing “meritless” petitions with the U.S. Food and Drug Administration (FDA), the FTC contends. These petitions reportedly repeated unsupported safety claims about the film version of Suboxone and urged the FDA to reject applications for generic tablet alternatives.

The FTC says these actions caused consumers to pay more for Suboxone when, in a healthy market, they would have otherwise been able to purchase less expensive generic versions of the medication.

In July 2020, Reckitt Benckiser agreed to a $50 million settlement to resolve these claims. Shortly after, Indivior agreed to pay $10 million to resolve the allegations.

In May 2021, the FTC distributed over $59 million to consumers who were prescribed Suboxone. Of this sum, $42 million was sent in the form of 37,212 checks while the remaining $16 million was sent as 14,663 prepaid debit cards. The 51,875 payments averaged $1,139.

With the remaining $500,000 from the settlement fund, the FTC is distributing payments to consumers who submit a valid claim form

These payments are only available to consumers who contacted the claims administrator after the original 2021 claim deadline and asked to be put on the waitlist for payments. Consumers cannot file a claim if they did not add their name to the waitlist before September 2021, even if they otherwise qualify for payments.

No deadline for exclusion or objection is listed on the settlement website. The Suboxone FTC settlement is not subject to final court approval.

In order to receive a payment from the Suboxone FTC settlement, consumers must submit a valid claim form by Nov. 26, 2022. To file a claim, consumers must use the ID number they received via email or mail.

  2. Philip Penna says:

I have been on Suboxone’s for 11 years. I now developed scoliosis. I am in constant critical pain and I cannot walk more than 20-30’feet at a time. I read online that the FDA conducted a study on Suboxone and the results showed that a number of people on Suboxone developed scoliosis. I have not been able to work for over a year now and I am totally destitute .Can you help me with this?

    1. Sheila Parrish says:

This is wrong, suboxones ruined my life!

  3. Lora wood says:

Please send me info on these cases and how to apply and for what lawsuits are still opened. Thanks

    1. Misty says:

What’s sad is I just found out about lawsuit so the people that where they n suboxone where not notified and now can’t file a claim it’s just wrong. Victims are not told and still to this day on Suboxone because of being mislead and lied to. Can’t get off because don’t have money for treatment and it’s hell doing it alone.

      1. Mel says:

If they sent you a claim number you can still file a claim?

  4. Susan Prendergast says:

If there should happen to be another lawsuit of how Suboxone has ruined people’s lives after short-term use. I would be very grateful to be contacted. I am living with chronic migraines and tinnitus that I never experienced until I met Suboxone. I felt very deceived by the doctor for not disclosing information. She put in her notes she told me all those things and she never did. My life is a living hell after 30 days on Suboxone. So grateful to be off of it with dealing with lingering side effects that I feel have truly ruined my life. I would love to be contacted because it is so wrong on every level.

  5. Susan Prendergast says:

I didn’t have my teeth rot. I was on it for 4 weeks and suffered migraines which I never had before in my life with tinnitus. I getting off of it after one month. The net doctors never talk to me about side effects or what’s so ever about how that is the devil drug. I went from taking pain medication to Suboxone. I am living with severe migraines and tinnitus. Suboxone has ruined my life. I am so sorry that the girl wrote that her teeth had rotted the doctors never gave me any information whatsoever and now I live in hell with migraines and terrible tinnitus. I am a grandmother of eight. I cannot take care of my grandchildren or have a normal life because of Suboxone.

    1. Misty says:

Truly some of us that where never notified have been on medicine for years and have lost much more than teeth. We are victims that was never notified it’s wrong and they should do something about it. For years have been on pain medicine then medicine like Suboxone to get rid of withdrawal now stuck on that it’s insane we where not notified before the deadline. I have no teeth thanks to these pharmaceutical companies and doctors. I also have lumps and issues in blood that they can’t figure out why.

  6. Chris says:

Received my check today. Though I am mad at myself for missing the first deadline. I sincerely would like to say thank you to all the lawyers and people at the FTC who fought for us by getting us all the money they could. Much appreciated!

    1. Brooke Faust says:

I need to be contacted because I received something in the mail from you guys with a claimant number on it. Does this mean I can still file?

  7. Kalb says:

    Got my check. $205.56.
Better than nothing! I’m happy with it.

  8. Mark M says:

As of April 11 2023 the Ftc will be sending 2,573 people checks totalling 369,000 dollars to those that were on the wait-list.

    1. Jennifer says:

I was on waiting list and I never received my check

      1. Mark says:

It’s coming, except it’s only 2.93 each month you were on it,instead of the original 35.27 they paid first round. Most people didn’t even know this was a thing ,I found out from a guy who never took the stuff and got 2400 dollars. Government is a joke.

        1. Misty says:

          1. Crystal K says:

I was not notified of the suboxone lawsuit and I was prescribed Suboxone films for 7 years! My teeth are crumbling, breaking off and leaving sharpe edges that ends up cutting my tongue when I try to eat or talk. I’ve been to the dentist and it’s going to cost thousands of dollars to get my smile back (which I don’t have) Currently I live in excessive pain everyday from an abused tooth and another broke/crumbled tooth that is root exposed. I can’t eat much of anything that requires chewing without the pain. I can’t smile anymore and I try to hide my mouth as I talk to ppl with my hand. It’s so embarrassing. I isolate myself and stay at home to avoid any contact with ppl which puts my depression in full effect. Someone,
anyone please help! The pharmaceutical company should have had warnings about this and they should have been responsible for properly contacting anyone that could’ve been affected by their wrong doings.

      2. HM says:

Have you gotten your check yet? I was on the second waitlist and filled out verified my claim was received but still waiting on a check. Contacted the settlement admin email a week ago and still no response. And I thought they were sent 2 weeks ago. Curious if they still sending them?

        1. Vasilica says:

I received a small card in the mail and chose to do nothing and so I waited and waited and just yesterday thought about the lawsuit and decided to Google and see if I could find out info. Well I never received anything about it being settled or checks being mailed out. I never got anything in the mail or email. Here I was thinking I should be getting a check soon cuz it’s been a long while. I read up that dead line passed. But how was I to know there was a deadline? I’m a bit upset. What can I do to talk with someone about this?

    2. Mark M says:

Sad thing is they are only paying $2.93 each month you purchased Suboxone and that’s a far cry from the 35.27 a month the original settlement settlement individuals received..feel kinda hustled.

      1. Blah blah says:

How did u find out they are only paying 2.93 a month?

        1. Mark M says:

Called the Suboxone settlement number, then hit 2. Guess they decided to do whatever they want, because they really don’t care otherwise they would have sued for over a billion dollars not just 2% of the profits company made on people who took this crap for help. It took me 6 months to even feel better when I got off this drug,it is worse than getting off the opioids the Drs had me on in first place.

      2. Misty says:

Many of us that where using this medicine didn’t know about lawsuit, so now we miss the deadline but you never told the victims.

  9. Joanna says:

13 years on it. Went from zero cavities or fillings to every tooth losing enamel. Spent thousands upon thousands every year and am still a slave to this bs that was completely misrepresented to me by doctors who believed big pharmas bs research. I paid top dollar out of pocket for appointments and suboxone strips for years and years because no generic was offered. I find out today that a suit was settled and the dead line is over already? 50 mill and you people couldn’t properly advertise or reach out? I watch the news daily and I still go to the doctor. No one could reach out to them or pharmacies to alert their clients? If money is owed and I can show proof of my valid claim then a dead line should not matter. In every other case the plaintiff/defendent/witness has to be contacted in order to lawfully penalize them. Please do the right thing and allow those who contact late to file.

    1. Aaron says:

I agree 13 consectutive years and still stuck takimg this crap. Never heard a word about any suit. Ieven contacted lawyers years ago about my belief that the medication was causing my teeth to rot. Not one lawyer was interested. This is typical big business, F the people who paid tens of thousands out of pocket and have no teeth left. I also had to pay cash for every visit and to fill the prescription most of the timw due to insurance companies constantly stopping the coverage for this medicine. There has to be a way we can sue ourselfs.

      1. Susan Prendergast says:

I didn’t have my teeth rot. I was on it for 4 weeks and suffered migraines which I never had before in my life with tinnitus. I getting off of it after one month. 2. Misty says:

Exactly it’s sad that the real victims where never notified. They know we where in it because going to pharmacy for this medicine is tracked. Sad we are told don’tatter and to late to file a claim.

      3. Dawn Rhoads says:

I do so so agree with you. Same here on this shit over 15 years and lost all my teeth. Now I find out that they just found out that suboxone causes tooth loss! I’m sure they knew about this from the beginning. I also never knew about the lawsuit. This is soo soo not fair !!

    2. Blah blah says:

Well u might have cavities or missing teeth but your alive. Thats the trade off when u get addicted to heroin and/or opiates. Big girl talk sweetie. This law suit is about the price people had to pay for it NOT the s/e. JS.

      1. Dawn Rhoads says:

What does it matter I also paid full cash the whole time iv been on suboxone and didn’t know about the lawsuit. They said the first round nobody needed to file a claim that they got your name from companies. That doesn’t make sense iv been paying and I didn’t receive any refund. Now they say all the money is gone. As far as loosing all teeth that is a big deal physically and mentally. Have some compassion girly!!

      2. Ryan barter says:

        Amen

    3. Bina says:

The suboxone isn’t causing your teeth issues. The dry mouth suboxone causes it what is causing your teeth issues. If you don’t treat the dry mouth, you’ll have issues.

      1. Em says:

Not true-I had no dental issues. 11 days of taking it and my mouth is chemically burned, my gums are literally dissolved and I have 4 loose teeth… I can’t drink water right now without starting my mouth bleeding. I had veneers and crowns for cosmetics.

      2. Dawn Rhoads says:

Not true at all look it up. It was just recently released that the medication causes tooth loss!!

        1. April says:

I have been on Beaufort norfrin for 3 years now. Since I have been taking it. 2 of my back teeth. That has to be either extracted or they said they may be able to. Do a root canal on both but not sure until they get in there and do the work on top of that, I have 12 cavities.
I have never had issues with my teeth. Other than just the normal that you would have before I started. Taking this medication, it’s like my teeth has just. Been falling apart little at a time. What can I do about this?

  10. Chris says:

Did anyone receive or hear anything yet about the 2nd round of checks?

    1. Mark M says:

As of today April 11 2023 Ftc is sending out checks to 2573 people for a total of 369,000 dollars per the Ftc Suboxone settlement page
