Snap Finance has established a $5 million fund to settle a class action lawsuit that claimed it routinely violated federal law by using an automatic telephone dialing system to call people who did not give consent.

The settlement class includes anyone living in the United States “(1) to whom Snap Finance LLC placed, or caused to be placed, a call, (2) directed to a number assigned to a cellular telephone service, but not assigned to a current or former Snap Finance LLC accountholder, (3) in connection with which Snap Finance LLC used an artificial or prerecorded voice, between Sept. 1, 2019, and June 14, 2022.

Snap Finance is accused of violating the TCPA, or the Telephone Consumer Protection Act. The original plaintiff claimed Snap Finance placed at least 60 calls in a three-month period. The TCPA forbids companies from making phone calls to people with whom they have not established a business relationship and obtained consent to call. The lead plaintiff was never a customer.

Snap Finance, based in West Valley City, Utah, is a financial services company. It markets to those who are credit challenged and in need of financing, providing “pay-over-time financing options to consumers,” according to CB Insights. The company claims, “Even with bankruptcy, poor or no credit, we still give you the best chance for approval.”

The TCPA is designed to protect consumers, preventing companies from spam-calling by using artificial or prerecorded voices. Without the TCPA protection, companies could use the technology to send limitless phone calls, ringing phones at all hours of the day nonstop. 

Under the terms of the Snap Finance class action lawsuit settlement agreement, class members are eligible to claim a cash payment.

Class members who submit valid and timely claim forms will each receive an equal share of the settlement fund after attorneys’ fees, administration costs and other expense are deducted.

Each class member is expected to receive an estimated payment of $300 to $1,000. The actual amount will depend on the number of claims the settlement administrator receives.

The deadline for class members to object to or exclude themselves from the settlement is Dec. 12, 2022. 

The final hearing is scheduled to take place take place Feb. 7, 2023.

Class members must submit a valid claim and release no later than Dec. 12, 2022.

Who’s Eligible

Anyone living in the United States:

  1. To whom Snap Finance LLC placed, or caused to be placed, a call
  2. Directed to a number assigned to a cellular telephone service, but not assigned to a current or former Snap Finance LLC accountholder
  3. In connection with which Snap Finance LLC used an artificial or prerecorded voice, between 09/01/2019 – 06/14/2022

    Hi All, I came online searching for answers as to where my 2nd check is from the Snap Finance settlement. Looks like I am not the only one concerned. I sent out numerous emails including my W9, which I sent on 04/15/2023. I had received multiple responses of a system-generated email stating the checks would be mailed in late August…here we are 09/12/2023 and nothing. Has anyone found another way to check the status yet? Appreciate the feedback and direction as these funds are desperately needed….

      Welcome to the Club! We are all in the same frustrated boat as we patiently wait for the promised check that should have been mailed late Aug. Here we are now in Mid September and still No check yet! I am owed this money and I still want it!!

        I am in the same boat. I have been waiting on this money since May. I emailed my W9 as requested. Which had my SSN on it mind you. So where the gel is our money?! They don’t have any updated automated system message and I’m pissed to be honest. Should we start reaching out to their lawyers?

      Nope!! No check received yet. It was suppose to be mailed out late August but have yet to receive it. I called the Claims Administrator phone number above and it is just a recorded line leads to nowhere. I sent a follow-up email and still no returned response. Not sure where this check lies….ugh

    I received the same $580 check and I went and deposit it at Chase Bank and in 2 days it was cleared and yes I spent the money it was real!

          I put mine in the bank on April 13th and it hasn’t returned yet but I emailed several times and no response and you call and it is automated stuff. When will I get the other $1900 and something??

            Same exact situation he is in. I received a surprising check in the mail of $580 on 04/17/23 attached with a W9 form to request the $1900.00 balance that I have yet to receive I am still waiting for this money. I have sent numerous emails and not gotten back any response. The phone number listed on the letter is an automated recording line. Can someone help me with my answers and when will I get the balance of my check???
