SiriusXM recently agreed to pay $96 million to resolve subscription claims against them.

UPDATE 2: According to the settlement website, claimants with Inactive Lifetime Subscriptions that supplied a valid Radio ID we’re reactivated on April 12, 2021. For claimants that selected the payment option, checks will be mailed on May 11, 2021.

SiriusXM lifetime subscribers may be able to claim up to $100 in cash from a $96 million settlement that ends a class action lawsuit alleging the streaming company falsely advertised the service.

Those who can benefit from the settlement agreement include those who purchased “Lifetime Plan” or “Lifetime Subscription” services from SiriusXM.

A series of class action lawsuits were lodged against the streaming company in 2016 and 2018 alleging false advertising.

The plaintiffs alleged that they purchased SiriusXM lifetime subscriptions, paying between $350 and $755. Under the terms of the plans, subscribers could activate SiriusXM, a radio streaming service, on up to four devices, as well as others for a $75 fee.

The plaintiffs claimed they believed the lifetime subscriptions were good for their lifetimes, but found that the subscriptions lasted the lifetime of the device the customer first used to set up the streaming service. They also alleged that they did not know transfers of the service were limited.

The class action lawsuit accused SiriusXM of duping consumers into paying more for so-called lifetime plans than they would have if they had known the plan was linked to the life of the radio, not their lifetime. They accused the streaming service of violating California consumer protection laws, breach of contract and fraudulent and negligent misrepresentation.

SiriusXM denied the allegations, claiming it clearly advertised that the lifetime subscriptions applied to the subscriber’s radio and not their own lifetime. However, the company agreed to pay $96 million to settle the SiriusXM lifetime subscription class action lawsuit in June 2020.

“Sirius XM has concluded, despite its belief that it is not liable for the claims asserted in the Cases and that it has defenses thereto, as well as meritorious positions in compelling arbitration in the Cases, that it is in Sirius XM’s best interests to enter into this Settlement Agreement to avoid further expense and burden, along with the distraction and uncertainty, of continuing protracted litigation, and thereby to resolve this controversy,” the settlement agreement states.

Under the terms of the class action settlement, individuals who purchased a SiriusXM subscription marketed as a “lifetime subscription” may be able to take part in the multimillion-dollar award. Each Class Member’s award will depend on whether they hold an active or inactive subscription.

Subscriptions that are active include plans that were authorized to receive SiriusXM service as of June 5, 2020, and continue to receive service. Inactive subscriptions are those that were no longer authorized to receive service as of June 5, 2020.

Class Members with active subscriptions are entitled to transfer their service to an unlimited number of SiriusXM enabled devices for a reduced fee of $35 per transfer.

Class Members with inactive SiriusXM lifetime subscriptions have two options. They may reactivate their subscription on a different satellite radio than they originally used to activate their service and are entitled to the reduced price transfer fees. Alternatively, they may claim $100 in cash and agree to have their inactive lifetime subscriptions permanently canceled.

Class Members with active subscriptions will automatically be entered into the settlement.

Those with an inactive subscription will need to submit a claim form either online or by mail by Jan 12, 2021, to be eligible. Claim forms require a Claim ID number available on the settlement notice. Class Members who did not receive a notice may verify their account on the settlement website to receive a Claim ID.

The deadline for Class Members to opt out of or object to the class action settlement is Nov. 30, 2020. The final hearing is scheduled for Jan. 25, 2021.

Who’s Eligible

Class Members include those who purchased “Lifetime Plan” or “Lifetime Subscription” services from SiriusXM.

Potential Award

Up to $100 cash or reduced fees for subscription transfers.

  • Class Members with SiriusXM lifetime subscriptions that were active as of June 5, 2020, can opt to transfer service an unlimited number of times to other radios for a reduced fee of $35.
  • Class Members with SiriusXM lifetime subscriptions that were inactive as of June 5, 2020, can opt to reactivate their service and are entitled to the unlimited number of transfers for the reduced fee of $35.
  • Alternatively, Class Members with inactive subscriptions can claim a $100 cash award and their subscription will be permanently canceled.
Proof of Purchase

Class Members with inactive subscriptions will need to provide a Claim ID number available on the settlement notice. Alternatively, Class Members can verify their accounts on the settlement website.

    i have an active serius lifetime subscription and was told 2 years ago that if i try to transfer it to another vehicle that they will not because i used up my transfers. how do i go about letting them know when i am getting another vehicle that the transfer is allowed now
