Acadia Healthcare criminal background check

Acadia Healthcare has agreed to fund a settlement to resolve class action lawsuit claims that they violated the Fair Credit Reporting Act.

The settlement benefits individuals who had a criminal background check procured for them by Acadia Healthcare based on a paper authorization and disclosure form within two years of the class action lawsuit.

According to plaintiff Sheryl Holly-Taylor, Acadia Healthcare Inc. and The Refuge – A Healing Place LLC violated federal law by mishandling criminal background checks for prospective employees. The companies allegedly inserted “extraneous information” into forms authorizing these background checks, failed to provide pre-adverse notice to applicants, and obtained consumer reports without the correct authorization.

The Acadia Healthcare class action lawsuit argued that these actions violated the Fair Credit Reporting Act (FCRA). The FCRA implemented a variety of protections for consumers when it comes to sharing their information to consumer reporting agencies, including credit bureaus. In part, FCRA standardized the disclosures and procedures required for obtaining a criminal background check during the employment process.

If a company fails to comply with FCRA, harmed consumers can take legal action and seek up to $1,000 in statutory damages per each violation. Holly-Taylor argued that Acadia Healthcare violated FCRA and, as such, she and other affected consumers were entitled to compensation.

The Acadia Healthcare defendants have not admitted any wrongdoing and instead deny any liability alleged in the class action lawsuit. However, in recent legal news, the companies agreed to resolve the claims against them in a class action settlement.

Under the Acadia Healthcare settlement, Class Members may be able to receive cash payments of up to $100. Exact payment amounts will vary depending on the number of claims filed along with any costs and expenses deducted from the settlement fund. Payments may be reduced on a proportional basis, but Class Members will all receive the same amount.

In order to benefit from the Acadia Healthcare settlement, Class Members must file a valid claim form by Sept. 16, 2020. A notice ID and notice PIN number are required to file a claim online.

The deadline for exclusion and objection is Sept. 16, 2020. By excluding themselves from the settlement, Class Members will not receive compensation from the fund, but will be able to retain their legal rights to take action against Acadia Healthcare in the future. Objecting to the settlement allows the Class Members to stay in the Class but voice their concerns about the settlement.

The final approval hearing for the Acadia Healthcare settlement is being held on Sept. 23, 2020, according to the settlement website. During this hearing, the court will make a final decision on the fairness of the settlement. If the deal is granted final approval and no appeals are filed, the payment process will begin.
