A P.F. Chang’s settlement resolves claims that it underpaid its servers in violation of federal labor laws.
The settlement benefits current and former P.F. Chang’s servers who worked at a location in Alabama, Arkansas, Florida, Georgia, Idaho, Illinois, Indiana, Iowa, Kansas, Kentucky, Louisiana, Maryland, Massachusetts, Michigan, Mississippi, Missouri, Nebraska, New Jersey, New Mexico, North Carolina, Ohio, Oklahoma, Pennsylvania, Rhode Island, South Carolina, Tennessee, Texas, Utah, Virginia or Wisconsin between Nov. 5, 2016, and July 8, 2020, and who opted into the case by the opt-in deadline.
According to the class action lawsuit, P.F. Chang’s paid its servers low wages and expected them to supplement their income with tips. However, the restaurant allegedly required them to perform excessive side work that did not generate tips, causing them to be paid under minimum wage in violation of the Fair Labor Standards Act.
P.F. Chang’s is a restaurant chain that serves Asian and Chinese food.
P.F. Chang’s has not admitted any wrongdoing but agreed to pay an undisclosed sum to resolve the FLSA class action lawsuit.
Under the terms of the P.F. Chang’s settlement, class members will receive a cash payment based on the hours they worked that were paid below minimum wage according to their hours and earnings history. No payment estimates are available at this time.
There is no objection deadline for the settlement. Class members who wish to exclude themselves must do so within 30 days of the final approval hearing, which has not been scheduled.
The settlement was granted preliminary approval on Aug. 15, 2024. A final approval hearing has not been scheduled.
To receive P.F. Chang’s settlement payments, class members must return a release form by Oct. 25, 2024.
