Certain former residents of the Oasis at Waipahu in Waipahu, Hawaii, may be able to claim an average of $5,000 as part of a nearly $2.6 million settlement.
The Class includes anyone who leased and lived in a housing unit at the Oasis at Waipahu at any point between May 17, 2013, and May 17, 2017, and “experienced the substantial presence” of pests, including rats, in their unit and were not notified of the pests’ presence by the complex.
The plaintiffs had claimed the Oasis at Waipahu violated state law by failing to provide habitable dwellings that were safe, sanitary, and pest-free.
The defendants deny all allegations of wrongdoing.
Class Members do not need to file a claim form to benefit from the settlement; they will automatically receive a check.
The amount of each payment will depend on the duration of the lease and the amount of rent paid, as calculated by Class Counsel.
Class Counsel estimates Class Members will receive an average payment of $5,000, with payouts expected to range between $1,000 and $19,833.
The payments will be made after attorney’s fees and other costs are paid from the settlement fund.
If the Oasis at Waipahu apartment unit had co-lessees, the payment will be made jointly payable to all named lessees.
If all co-lessees join a single written request to the settlement administrator for separate checks, the payments may be distributed separately. Anyone wishing to submit such a request should contact the settlement administrator to obtain a form.
Class Members who received a settlement notice at a valid mailing address are not required to verify their address in order to receive a payment.
However, they are encouraged to do so, either with Class Counsel or through the settlement website so counsel and the administrator have your most current contact information.
A final approval hearing is scheduled for May 4, 2021.
Objections to this settlement must be submitted by mail and postmarked no later than April 5, 2021.
No claim form is required for the Oasis at Waipahu pest settlement.
