A Magellan RoadMate Navigator class action settlement has been reached to resolve false advertising claims that drivers would be able to receive free updates.
The settlement benefits individuals who purchased a Magellan RoadMate Navigator with free lifetime map updated between Sept. 28, 2014 and June 30, 2019.
Plaintiffs Michael Livingston and Sharon McGill filed their Magellan RoadMate Navigator class action lawsuit against MiTAC Digital Corporation, claiming they were misled by the company’s representations that they would receive free lifetime updates.
Allegedly, the plaintiffs and other consumers purchased the navigator products based in part on representations that they would receive free lifetime updates for their maps. However, the consumers reportedly learned later that they would be required to pay for these map updates instead of receiving them for free.
The plaintiffs claim they would not have purchased the Magellan RoadMate Navigator products or would have paid significantly less for them had they known the truth about the map updates.
MiTAC has not admitted any wrongdoing but has agreed to settle Livingston and McGill’s claims in a settlement. According to the settlement website, the deal was reached in May 2019 after a mediation session with Jay C. Gandhi, “a former federal judge who is an experienced and well-respected class action mediator.”
“Defendant has considered the risks and potential costs of continued litigation and the benefits of the proposed settlement, and desires to settle the Action upon the terms and conditions set forth in this Settlement Agreement,” the Magellan RoadMate Navigator settlement agreement states.
Similarly, the plaintiffs reportedly believe that their claims have merit but agreed to the settlement to secure compensation and avoid the risks of further litigation.
The settlement offers two benefits: a lifetime map subscription and reimbursement for previously purchased map updates.
A lifetime map subscription will reportedly provide free updates for Class Members’ devices for a period of three years. After this period, Class Members will be eligible to renew their subscription free of charge. This three year subscription period will reportedly continue, with no charges for the Class Members, until they no longer use their eligible devices.
Instead of a traditional claim form, Class Members must register on Magellan’s website by Sept. 17, 2020 in order to receive a lifetime map subscription from the Magellan RoadMate Navigator settlement.
Claims for map update reimbursements must also be submitted by this date. Reimbursement requires various forms of documentation including a Class Member’s Magellan RoadMate Navigator model, serial number, purchase date, and associated email address, along with details about a map update purchase.
The deadline for exclusion and objection is Aug. 18, 2020. The final approval hearing for the Magellan RoadMate Navigator class action settlement is Nov. 4, 2020.
Who’s Eligible
Individuals who purchased a Magellan RoadMate Navigator with free lifetime map updated between Sept. 28, 2014 and June 30, 2019.
Potential Award
Free lifetime map subscription and reimbursement for previously purchase map updates.
Proof of Purchase
Magellan RoadMate Navigator model, serial number, purchase date, and associated email address, along with details about a map update purchase.

I have my receipt Sept 5 2014 which is outside of the required timeline but paperwork says it includes “FREE” lifetime map updates. I have the user handbook and the container that the ” Roadmate “came in. I would just like my devise updated ” FREE” like the literature says.
