Louisville and Jefferson County, Kentucky, authorities agreed to a $1.5 million class action settlement to resolve claims they violated ordinances by charging improper towing fees.

The settlement benefits individuals who were assessed a storage fee of $10 for each day their vehicle was stored, plus a $5 fee for each additional day after seven days their vehicle was stored, by Louisville and Jefferson County Metro Government.

According to the class action lawsuit, Louisville and Jefferson County Metro Government violated city and county ordinances by charging excessive fees to store towed vehicles. The plaintiffs in the case say they were financially injured by these unlawful fees. 

The Louisville/Jefferson County Metro Government is the government entity that controls Louisville and Jefferson County. 

Louisville and Jefferson County authorities haven’t admitted any wrongdoing but agreed to a $1.5 million settlement to resolve the towing fees class action lawsuit.

Under the terms of the settlement, class members can receive a cash payment. 

Class members with claims from Feb. 2, 2008, to March 14, 2014, will receive a cy pres payment, and class members with claims from March 15, 2013, to March 19, 2021, will receive a cash payment. 

Exact details of payment distribution are not available on the settlement website. 

The deadline for exclusion and objection was May 29, 2023.

The final approval hearing for the settlement is scheduled for July 19, 2023.

In order to receive a settlement payment, class members must submit a valid claim form by June 13, 2023.
