Harmony Nursing & Rehabilitation Center agreed to a class action settlement to resolve claims that it violated the Illinois Biometric Information Privacy Act (BIPA) by using fingerprint time clocks without providing certain disclosures. 

The settlement benefits individuals who worked for Harmony Nursing & Rehabilitation Center in Illinois between Feb. 22, 2015, and Feb. 23, 2023, who used a fingerprint scanning time clock before signing a biometric consent form.

Harmony Nursing employees say their privacy rights were violated by fingerprint timekeeping devices used by the nursing and rehabilitation center. According to the class action lawsuit, Harmony failed to provide disclosures and obtain consent as required by BIPA.

Harmony Nursing is a rehabilitation and healthcare center in Chicago. The center offers a number of services including orthopedic rehabilitation, post-hospital rehab, various types of therapy, long- or short-term care and 24-hour medical care.

Harmony hasn’t admitted any wrongdoing but agreed to pay an undisclosed sum to resolve the BIPA allegations.

Under the terms of the Harmony Nursing settlement, class members can receive an equal share of the net settlement fund. 

Each class member is estimated to receive between $500 and $600, but exact payments will vary.

The deadline for exclusion and objection is April 10, 2023.

The final approval hearing for the settlement is scheduled for June 1, 2023.

No claim form is required to benefit from the settlement, but class members do have the option to update their addresses on the settlement website to ensure they receive their payments.
