GlaxoSmithKline (GSK) agreed to a class action settlement to resolve claims its “Big Bad Cough” advertising campaign misled viewers about Boostrix’s ability to prevent whooping cough.
The Boostrix class action settlement benefits adults who viewed the “Big Bad Cough” advertising campaign and either lived in New York at the time or were vaccinated with Boostrix in New York between May 20, 2016, and May 20, 2020.
The “Big Bad Cough” advertising campaign ran between 2015 and 2020 and featured advertisements with humanized wolves to promote the GSK vaccine Boostrix. Boostrix is a tetanus, diphtheria and whooping cough vaccine.
According to a class action lawsuit, the “Big Bad Cough” campaign misled consumers about Boostrix’s ability to prevent whooping cough from spreading to others. Plaintiffs in the case say they would not have purchased the pertussis vaccination if they had known the truth.
GSK has not admitted any wrongdoing but agreed to pay an undisclosed sum to resolve the allegations.
Class members can receive a cash payment from the Boostrix class action settlement.
Class members who provide proof of vaccination can receive a payment of $50. Those who do not provide proof of vaccination but submit an attestation of vaccination can receive a payment of $10.
The deadline for exclusion and objection is May 11, 2026.
The final approval hearing for the GSK Boostrix settlement is scheduled for July 2, 2026.
To receive settlement benefits, class members must submit a valid claim form by June 8, 2026.
Who’s Eligible
The class action settlement benefits individuals who viewed GlaxoSmithKline’s “Big Bad Cough” advertising campaign between May 20, 2016, and May 20, 2020, and either lived in New York at the time or were vaccinated with Boostrix in New York.
Potential Award
$50 with qualifying proof of vaccination; $10 without qualifying proof of vaccination
Proof of Purchase
Qualifying proof of vaccination includes a copy of a vaccination record that must include the name of the person vaccinated, the date of the vaccination and the name of the vaccine. An attestation of vaccination is a signed statement that the individual was vaccinated with Boostrix during the class period and that the information provided on the claim form is true and correct.
