
Francesca’s agreed to a class action lawsuit settlement to resolve claims that it failed to protect consumers from a 2023 data breach.
The Francesca’s settlement benefits individuals whose personal information was compromised in a data breach that occurred between Jan. 12 and Jan. 31, 2023.
In September 2023, Francesca’s announced that an unauthorized third party had accessed its network and files between Jan. 12 and 31, 2023. The Francesca’s data breach reportedly compromised sensitive employee and customer information, such as names, addresses, Social Security numbers, driver’s license numbers and financial account information.
Plaintiffs in the class action suit claim that Francesca’s could have prevented the breach through reasonable cybersecurity measures.
Francesca’s is a women’s clothing retailer with more than 700 locations across the country.
Francesca’s has not admitted any wrongdoing but agreed to pay an undisclosed sum to resolve the data breach class action lawsuit.
Under the terms of the Francesca’s settlement, class members can receive up to $1,500 for ordinary losses, such as bank fees, communication charges and credit expenses, and up to five hours of lost time at a rate of $25 per hour.
Class members can also receive up to $5,000 for extraordinary losses resulting from the data breach. These losses must be documented and unreimbursed and must have occurred between Jan. 12, 2023, and Nov. 10, 2025.
Class members who do not wish to claim ordinary and extraordinary losses can instead receive an alternative cash payment of $50. Class members who lived in California at the time of the data breach can receive an alternative payment of $75.
All class members, regardless of whether they submit a claim, can receive two years of credit monitoring services through the settlement.
The deadline for exclusion and objection is Oct. 10, 2025.
The final approval hearing for the Francesca’s settlement is scheduled for Nov. 13, 2025.
To receive settlement benefits, class members must submit a valid claim form by Nov. 10, 2025.
Who’s Eligible
Individuals whose personal information was compromised in the Francesca’s data breach that was discovered in January 2023 and that they were notified of via a data breach notice sent on or after Sept. 25, 2023.
Potential Award
Up to $6,500 in documented losses or a cash payout of $50 or $75 for California residents.
Proof of Purchase
Documentation of losses, such as bank statements, credit card statements, invoices and receipts.
