A $750,000 settlement has been reached in a class action lawsuit alleging the Fairways at Lake Ridge community in Lakewood, New Jersey, was falsely marketed as a golf community adjacent to a golf course that would remain in perpetuity.
Anyone who purchased a home in the Fairways at Lake Ridge community and continued to own that home as of Feb. 14, 2017, or if they executed a sales contract to purchase a home in the Fairways community before Feb. 14, 2017, but closed after that date may be entitled to compensation from the Fairway at Lake Ridge class action settlement.
The Fairways at Lake Ridge community had an adjacent 18-hole golf course, which the defendants allegedly marketed as remaining in perpetuity. However, the Fairways at Lake Ridge class action lawsuit alleges the defendants sold the golf course to a third-party developer that intended to build a new residential community on the land, App reported.
The plaintiffs assert their home value diminished as a result of the planned sale of the golf course to a developer who planned to develop it as a residential community.
The Fairways at Lake Ridge class action lawsuit claims the defendants violated the New Jersey Consumer Fraud Act and the New Jersey Planned Real Estate Development Full Disclosure Act.
The defendants deny any wrongdoing but agreed to settle the Fairways at Lake Ridge class action lawsuit without admitting liability.
Eligible class members who do not opt out will automatically receive payment if the settlement is granted final approval. Only one payment will be issued per household regardless of the number of eligible Class Members living in that household.
The total amount each household will receive will depend on the total number of Class Members who participate in the Fairways at Lake Ridge settlement.
The final hearing is scheduled for Aug. 12, 2022.
The deadline to opt out of or object to the class action settlement is July 22, 2022. No claim form is required, but class members who need to update their address and contact information may do so on the settlement website.
