The Federal Aviation Administration agreed to pay $47.5 million as part of a settlement to resolve Equal Employment Opportunity Commission (EEOC) claims it engaged in air traffic controller age discrimination.
The settlement benefits PATCO inventory applicants who were not selected for air traffic control specialist vacancies between Sept. 16, 2003, and Oct. 31, 2012.
The plaintiff in the complaint filed his complaint with the EEOC in 2004, alleging he and other air traffic control specialists were discriminated against based on their ages. This discrimination allegedly caused the plaintiff and other specialists to be denied placement in open air traffic control positions.
The Federal Aviation Administration (FAA) is part of the U.S. Department of Transportation which governs aviation — including air traffic control positions.
The FAA and Department of Transportation haven’t admitted any wrongdoing but agreed to resolve the EEOC complaint with a $47.5 million settlement.
Those who qualify to file a claim under the terms of the EEOC settlement can receive a cash payment based on the monetary damages they sustained as a result of unlawful discrimination. Exact payments will vary; no payment estimates are available.
There is no exclusion or objection deadline for this settlement.
The settlement was finalized on March 16, 2023.
In order to receive a settlement payment, those who qualify must return their mailed claim and release form by June 1, 2023.

What if they are still discriminating by age? According to the website, “Candidates applying to an ATCS Trainee announcement must be age 30 or below, cannot be age 31 as of the closing date of the vacancy.”

There is a minor inaccuracy in the article. When stating who was eligible for a portion of the settlement, the article’s author stated: “PATCO inventory applicants who were not selected for air traffic control specialist vacancies between Sept. 16, 2003, and Oct. 31, 2012.” However, in order to be discriminated against because of one’s age, the complainant has to have been over forty years old at the time of the alleged discriminatory event. Technically, then, the statement on “eligibility” should more accurately have read: “PATCO inventory applicants who were OVER FORTY YEARS OLD AT THE TIME OF APPLICATION, but were not selected for air traffic control specialist vacancies between Sept. 16, 2003, and Oct. 31, 2012.” . . . . nit-picking, perhaps, but the practice of law is all about finding and picking the “genuine issues of materail nits”
