Discover agreed to a $1 million class action lawsuit settlement to resolve claims it violated the federal Telephone Consumer Protection Act (TCPA) with unsolicited phone calls about accounts the call recipients did not own.

The settlement benefits individuals who were not Discover customers but received a phone call from Discover that used an artificial or prerecorded voice between Aug. 25, 2017, and Feb. 7, 2023, where the subject of the call was a credit card account issued by Discover.

Plaintiffs in the TCPA class action lawsuit accused Discover of contacting them with illegal robocalls regarding accounts they didn’t own. According to the class action lawsuit, these calls violated the TCPA.

Discover is a credit card company that offers home equity loans, student loans and other lending opportunities. 

Under the terms of the Discover TCPA settlement, class members can receive a cash payment. 

According to the settlement website, each claimant is estimated to receive between $40 and $110. Exact payments will vary depending on the number of valid claims filed.

No residual funds will revert to Discover after payments are made. Funds will be used for a second round of payments if there are enough funds remaining, and then any remaining funds will be donated to court-approved charities.

The deadline for exclusion and objection is June 7, 2023.

The final approval hearing for the Discover unsolicited calls settlement is scheduled for July 25, 2023.

In order to receive a settlement payment, class members must submit a valid claim form by June 7, 2023.
