Individuals may be able to benefit from a $1.55 million InterContinental hotel class action settlement if they were affected by various data breaches.

The settlement benefits consumers who used a credit or debit card at an InterContinental Hotels Group (IHG) hotel between Aug. 1, 2016 and Dec. 19, 2016.

IHG hotel brands include InterContinential, Holiday Inn, Holiday Inn Express & Suites, Candlewood Suites, Crowne Plaza, Staybridge Suites, and Hotel Indigo.

Plaintiffs David Orr, Henry Chamberlain, Angela Mickel, and Jennifer Grady took action against InterContinental hotels companies in 2017, claiming that they were injured as a result of a widespread data breach.

Allegedly, the data breach affected more than 1,000 InterContintental hotel locations and resulted in hackers accessing sensitive payment information including card numbers, expiration dates, verification codes, and cardholder names for debit or credit cards used at the hotels.

The plaintiffs claimed the data breaches were a direct result of IHG’s inability to protect consumer data. According to the InterContinental hotel class action lawsuit, the data breaches could have been avoided if the company implemented proper cybersecurity measures.

“The Security Breach was caused and enabled by [Intercontinental Hotels Group’s] knowing violation of its obligations to abide by best practices and industry standards concerning the security of payment systems,” the plaintiffs alleged in their InterContinental hotel class action lawsuit.

“[Intercontinental Hotels Group] failed to comply with security standards and allowed its customers’ financial information to be compromised by cutting corners on security measures that could have prevented or mitigated the Security Breach that occurred.”

The InterContinental hotel class action lawsuit included a variety of claims including counts of negligence, negligence per se, breach of implied contract, and unjust enrichment. IHG did not admit any wrongdoing but has agreed to resolve the claims against them with a settlement.

A total of $1.55 million is available to fund payments to Class Members. Each Class Member will be able to collect up to $3,750 in cash payments from this fund.

Class Members can collect up to $250 in reimbursement for documented out-of-pocket expenses and up to $3,500 in reimbursement for documented fraudulent or unauthorized losses. These expenses and losses must be documented and shown to be a direct result of a data breach incident.

In order to recover compensation from the settlement, Class Members must file a claim with documentation by Sept. 12, 2020. The deadline for exclusion and objection is Aug. 12, 2020. The final approval hearing for the InterContinental hotels class action settlement is Sept. 2, 2020.

Consumers who used a credit or debit card at an InterContinental Hotels Group (IHG) hotel between Aug. 1, 2016 and Dec. 19, 2016.

Potential Award

Cash payments of up to $3,750.

Class Members can collect up to $250 in reimbursement for documented out-of-pocket expenses and up to $3,500 in reimbursement for documented fraudulent or unauthorized losses.

Documentation of out-of-pocket expenses or fraudulent/unauthorized losses.
