General Electric has agreed to pay up to $20 million to resolve claims brought in a GE shattering microwave class action lawsuit.
The settlement benefits individuals who purchased or owned a GE Profile or GE Monogram brand microwave oven bearing a model number beginning with JEB1090, JEB1095, ZMC1090, or ZMC1095 at any time between Jan. 1, 1995 and Jan. 15, 2020. An estimated 68,000 eligible microwaves were manufactured between 1995 and 2007.
Plaintiffs filed their GE shattering microwave class action lawsuit in 2013, claiming that General Electric sold microwaves which had glass prone to spontaneously shattering or breaking. The shattering allegedly occurred two to three years after purchase.
According to the plaintiffs, General Electric refused to cover these costs under warranty and instead forced consumers to cover the costs of replacement doors or units which would shatter just like the original microwave.
The plaintiffs brought a variety of claims in their GE shattering microwave class action lawsuit, including breach of express warranty, breach of implied warranty, and unjust enrichment as well as violations of the federal Magnuson-Moss Warranty Act, and violations of New York and Ohio consumer protection laws.
In April 2015, a federal judge dismissed the claims of breach of implied warranty and violation of the Ohio Consumer Sales Practice Act, but allowed other claims to move forward.
General Electric has not admitted any wrongdoing in the GE shattering microwave class action lawsuit but has agreed to a settlement worth up to $20 million to resolve the claims against them.
The settlement provides monetary compensation of up to $300. The largest $300 award is available for Class Members who experienced a GE shattering microwave incident.
Smaller awards are available for Class Members who did not experience a GE shattering microwave incident – $5 for Class Members who still own the microwaves and $5 rebates for Class Members who no longer own the microwaves.
In order to benefit from the GE shattering microwave class action settlement, Class Members must file a valid claim form by Oct. 14, 2020.
Claims can be filed online or mailed in. Documentation may be required for claims, including photos or other shattering incident documentation, receipts, microwave serial numbers, and more.
The deadline for exclusion and objection is June 15, 2020. The final approval hearing for the settlement it scheduled for July 16, 2020.
