The Centerspace settlement resolves claims the company failed to protect personal information during a cybersecurity incident that occurred in or around November 2021.
The settlement benefits all individuals who reside in the United States and received notice from Centerspace that a security incident impacted their personal information.
The class action lawsuit alleges Centerspace requires prospective tenants, tenants, prospective employees and employees to disclose their personally identifiable information to receive housing and employment. However, the company allegedly failed to protect this information, resulting in a data breach. The lawsuit also alleges Centerspace failed to inform impacted individuals about the breach for about eight months.
Centerspace is a real estate company focused on the ownership, management, acquisition and redevelopment of apartment communities across the Midwest but predominantly in Minneapolis, Minnesota.
Centerspace denies the allegations and any liability or wrongdoing but agreed to a settlement.
Under the terms of the Centerspace settlement, affected consumers can receive cash and other benefits. Qualifying class members can receive cash payments for ordinary losses up to $525 per claimant and extraordinary losses up to $5,250 per claimant, and lost time claims of $18.75 per hour for up to four hours for a total of $75 and subject to the $525 cap. Class members can also choose an alternative cash payment of $30. All settlement class members can also claim credit monitoring services and identity theft protection for two years with $1 million in identity theft insurance,
The deadline for exclusion or objection was Oct. 27, 2024.
The final approval hearing has been scheduled for Dec. 4, 2024.
To receive a portion of the Cyberspace settlement, class members must submit a valid claim form by Nov. 26, 2024.
