In recent legal news, Amica Insurance agreed to fund a settlement to resolve claims that the insurance company mishandled total loss payouts.

The Amica Insurance class action settlement benefits individuals who were insured under an Amica Insurance automobile policy in Florida, had a vehicle with auto physical damage coverage for comprehensive or collision loss, and who submitted a first-party claim under the policy where the vehicle was declared a total loss on or after July 2, 2014.

Plaintiff Tiana Cruz-Santiago filed her Amica Insurance class action lawsuit in July 2019, claiming she was denied the full value of her total loss payment due to the insurance provider’s policies.

A vehicle may be declared a total loss under a variety of circumstances, including whether or not the vehicle can safely be repaired, if the damage to a vehicle after a crash exceeds the vehicle’s value or if the damage exceeds the state’s damage threshold.

In the case of a total loss, consumers will typically receive a payout from their insurance company equaling the vehicle’s “actual cash value.” Unfortunately, according to Cruz-Santiago, Amica Insurance miscalculates these payments by failing to compensate policyholders for the costs of title and registration transfer fees.

As a result, consumers such as Cruz-Santiago are allegedly shortchanged when they’re forced to purchase a new vehicle and transfer their title and registration following a total loss. The Amica Insurance class action lawsuit argued that these actions violated Florida law.

Amica Insurance has not admitted any wrongdoing. However, the insurance company has agreed to fund a settlement to resolve the claims against them and provide monetary compensation to affected consumers.

Under the Amica Insurance settlement, Class Members will be eligible to recover a payment of $79.85 for title and registration transfer fees.

In order to receive benefits from the Amica Insurance total loss class action settlement, Class Members must file a valid claim form by Dec. 4, 2020. Amica Insurance policy numbers or total loss claim numbers are needed to validate settlement claims.

The deadline for exclusion and objection is Aug. 10, 2020. Exclusion will exempt a Class Member from compensation by removing them from the Class but will allow them to retain their legal rights to take action against Amica Insurance in the future. Objection doesn’t exclude Class Members from the settlement, but instead voices concerns or issues with settlement terms.

Class Members who fail to either exclude themselves or file a claim by the relevant deadlines will still have their rights affected, the settlement notice states. Their claims will automatically be released, meaning they cannot take legal action against Amica for the same issue in the future.

The final approval hearing for the Amica Insurance class action settlement is scheduled for Nov. 4, 2020. During this hearing, the court will make a final decision on the settlement’s fairness.

Who’s Eligible

Individuals who were insured under an Amica insurance automobile policy in Florida covering a vehicle with auto physical damage coverage for comprehensive or collision loss and who submitted a first-party claim under the policy where the vehicle was declared a total loss on or after July 2, 2014.

Potential Award

Cash payments of $79.85 in title and registration tag transfer fees.

Amica Insurance policy numbers or total loss claim numbers.
