Emtal Talc has agreed to pay $72.5 million to resolve claims their products led to asbestos exposure and related health problems. The settlement provides cash payments to affected individuals or family members.

The settlement benefits individuals, their family members or representatives of deceased people who were a party in an asbestos injury or wrongful death lawsuit filed between March 8, 1984 and March 29, 2011, which named Engelhard Corporation, BASF Catalysts LLC or subsidiaries as a defendant. The lawsuits must have been voluntarily or involuntarily dismissed.

Emtal Talc products were previously sold by an Engelhard subsidiary for use in a variety of industrial products such as tires, other rubber goods, paints, plaster, caulking and auto-body repair products. Although talc can be used in cosmetics, the current settlement does not include personal cosmetic products such as baby powder.

Between 1984 and 2011, numerous lawsuits were allegedly filed against Emtal alleging that the products resulted in dangerous asbestos exposure.

Asbestos is a naturally mined mineral that can be found in the earth close to talc deposits. Unfortunately, unlike talc, which has numerous applications, asbestos is a known carcinogen. If talc is contaminated with asbestos during the mining process, consumers may be exposed to the carcinogen.

Asbestos exposure has been linked with a variety of health issues such as lung problems and cancer, including lung cancer and mesothelioma.

Engelhard has not admitted any wrongdoing or liability as alleged in Emtal Talc asbestos exposure lawsuits. However, Engelhard and BASF Catalysts — which bound Engelhard in 2006 — have agreed to fund a $72.5 million settlement to resolve claims surrounding the issue.

The Emtal Talc asbestos exposure settlement will provide cash payments to qualified claimants, although exact payment amounts will vary.

Payments will be distributed based on a variety of factors including the number of claims filed, the disease level alleged by the claimant, evidence provided and more. Claimants who seek mesothelioma compensation may receive an additional payment from the settlement’s Extraordinary Injury Fund.

In order to benefit from the Emtal asbestos exposure settlement, Class Members have until Jan. 15, 2021, to file a valid claim. Claimants have until Feb. 19, 2021, to provide supporting documentation for a disputed claim form. Supporting documentation may include evidence of asbestos-related bodily injuries and other damages.

The settlement website notes there is an alternative claim form for people filing on behalf of a deceased injured party with no estate open (i.e., no personal representative appointed). All other claimants should use the settlement’s standard claim form.

The deadline for exclusion and objection is Dec. 16, 2020. The final approval hearing for the Emtal asbestos exposure class action settlement is scheduled for July 29, 2021.

    My father and mother both died as a result of this companies negligence.they passed away 2 years apart from each other 2009 and 2011. we are a part of this claim. this has destroyed our family from the inside out. we watched our parents Good people suffer the wrath of this deadly powder. this company has taken a mother a father,uncle,aunt,sister,brother and grandparents from us and know amount will ever fix what they have caused. my sister and i both suffer from PTSD because of the stress this has caused to everyone of us.
    we have yet to be compensated for there negligence and the destruction of good peoples lives.
    I demand transparency we have been kept in the dark about this settlement and we want answers Please.
