Montage Hotels & Resorts Credit Card Receipt Class Action Settlement

Several hotel companies have agreed to pay into a $500,000 settlement to resolve FACTA class action claims against them.

The settlement will benefit individuals who had an electronically printed receipt contain more than the last 5 digits of their payment card and/or their card’s expiration date. This applies to receipt printed at: the Pendry Hotel San Diego between Jan. 1, 2017 and June 20, 2017; the Pendry Hotel Baltimore between Mar. 1, 2017 and June 30, 2017; or the Montage Hotel Palmetto Bluff between Nov. 1, 2014 and June 30, 2017.

Plaintiffs Briny Woods and Greg Abraham filed their FACTA class action lawsuit in late 2018. They named several defendants in their complaint, including Montage Hotels & Resorts LLC, KT Hotels LLC, PBLH LLC, RGC Gaslamp LLC, and 1715 Thames Street Master Tenant LLC.

According to the class action lawsuit, the hotels violated the Fair and Accurate Credit Transactions Act (FACTA). FACTA requires retailers to only print the last five digits of a card number and prohibits any inclusion of expiration date information.

The defendants do not admit any wrongdoing by agreeing to settle the case against them. Instead, the settlement provides a way for all parties to resolve the class action without the costs and risks of continued litigation.

In order to receive payment, consumers need to file a valid claim by May 24, 2019. Claims forms can be submitted online or can be printed out and mailed directly to the settlement administrator.

The deadline for objection or exclusion is May 24, 2019. The final approval hearing is scheduled for June 5, 2019.

Who’s Eligible

Consumers who were provided an electronically printed receipt at the reception desk containing more than the last five digits of their payment card and/or the expiration date, which was printed at:

• the Pendry Hotel San Diego between Jan. 1, 2017 and June 20, 2017;
• the Pendry Hotel Baltimore between Mar. 1, 2017 and June 30, 2017; or
• the Montage Hotel Palmetto Bluff between Nov. 1, 2014 and June 30, 2017.

Potential Award

Varies. The amount each Class Member can recover will depend on the number of valid claims filed and the net settlement fund left over after payment of administrative costs, court costs, fees, attorneys’ fees, and service awards.

Proof of Purchase

ILYM ID found on the settlement notice or a valid email address. Class Members without this information must contact the settlement administrator.
