A $220 million JFK Medical Center settlement has been reached to settle claims that various Florida hospitals overcharge certain patients for emergency room services.

Plaintiffs Marisela Herrera and Nicolas Acosta filed their insurance class action lawsuit in August 2014. The class action claimed that Florida HCA-affiliated hospitals wrongfully charged patients with personal injury protection (PIP) insurance unreasonable amounts for emergency room services including X-rays and CT scans.

In Florida, vehicle owners are required by law to hold $10,000 worth of PIP insurance. PIP insurance will typically cover 80 percent of liability and the driver or passenger involved in an incident will cover the other 20 percent.

Plaintiffs claimed that HCA-affiliated hospitals in Florida charge PIP insurance holders more than 20 percent for emergency room services, which often exceeds the $10,000 PIP insurance limit.

The claims were resolved with a $220 million settlement reached in August 2018. The x-ray billing class action settlement will benefit future patients of JFK Medical Center and other HCA-affiliated hospitals in Florida.

A Florida HCA-affiliated hospital is defined under the settlement as any hospital in the state of Florida which operates an emergency department and is owned by HCA Holdings Inc. One example is JFK Medical Center, but the full list of Florida HCA-affiliated hospitals is available on the settlement FAQ page.

Eligible patients at JFK Medical Center and other HCA-affiliated hospitals in Florida will receive a discount to be applied after PIP insurance pays the hospital for a portion of their bill. To be eligible for this discount, patients must lack a secondary insurance to pay any remaining balance after PIP insurance payment.

Notably, this JFK Medical Center settlement does not preclude any individual claims brought regarding the issue. This means that, by participating in this settlement, Class Members do not give up their legal rights to further pursue compensation.

Who’s Eligible

Patients who, for four years from the effective date to be decided by the court, receive medical services in the emergency department of JFK Medical Center or another Florida HCA-Affiliated Hospital and whose Florida PIP insurance pays for a portion of the services but lacks a secondary insurance and has a remaining balance after payment by their PIP insurance.

    I wish I would of known this. I went to largo med after an accident in years ago! They wouldn’t even cast my broken wrist said it wasn’t an emergency and bam all was lost

    This one is not quite right- it does not require you to file, however you are supposed to provide proof that you did not have secondary insurance…. how do you know if you are even going to be included???The hospital in my town is named and they are the worst hospital ever – they killed my sister…. I hope they loose everything….
