A settlement has been reached in a class action lawsuit alleging The Scotts Miracle-Gro Company Inc. and The Scotts Company LLC falsely claimed that Scotts Turf Builder EZ Seed grows grass “50% Thicker With Half The Water” when compared to ordinary seeds.

If you purchased Scotts Turf Builder EZ Seed in California or New York, you may be entitled to a cash payment from the class action settlement.

The Scotts EZ Seed class action lawsuit accuses the defendants of selling a defective combination mulch-grass seed product that contains mulch, grass seed and fertilizer.

When it began selling the EZ Seed product in 2009, Scotts described it as a “revolutionary seeding product” that contains an absorbent growing material that uses the water it absorbs to expand and surround seeds with a moist, protective layer that provides the seeds with water and nourishment.

“According to the label, it is supposed to make EZ Seed grow grass ‘50%THICKER WITH HALF THE WATER’ compared to ordinary seed,” the Scotts EZ Seed class action lawsuit says. “But it doesn’t work. The super-absorbent mulch competes with the germinating seed for available moisture and actually prevents it from growing.”

The Scotts EZ Seed class action lawsuit claims that the product packaging and advertisements on television, radio and the internet are “replete with false and misleading statements about the nature, characteristics and qualities of EZ Seed.”

The plaintiffs point to studies showing that the EZ Seed product failed to grow grass in testing performed by precisely following the instructions on the label.

A judge granted Class certification to the Scotts Turf Builder EZ Seed class action lawsuit in January 2015.

The defendants deny the allegations but agreed to settle the Scotts EZ Seed class action lawsuit to avoid the burden and uncertainty of ongoing litigation.

Who’s Eligible

Class Members of the Scotts EZ Seed settlement include consumers who purchased any variety of Scotts EZ Seed bearing the 50% Thicker Claim in California or New York between Jan. 1, 2009 and Sept. 30, 2014.

According to the settlement documents, the 50% Thicker Claim refers to the following language: “50% Thicker With Half The Water* *Versus ordinary seed when each was watered at half the recommended rate. Results may vary.”

Potential Award

Up to $90.

Class Members who submit valid Claim Forms without proof of purchase will receive a payment of $15 or more per package, up to $45. Class Members who provide proof of purchase may claim up to six packages for a total of $90.

Proof of Purchase

None required. However, Class Members who do not provide proof of purchase are limited to an award of up to $45 while those who submit proof of purchase may claim up to $90.

    I CONTACTED THEM SEVERAL TIMES TO GET REFUND WITHOUT ANY LUCK.ALL I GOT WAS THE RUNAROUND & I HAD NUMBERS NEEDED OFF POSTCARD THEY SENT ME..THE GRASS SEED IS A WASTE OF MONEY !!DON’T GROW WORTH A DAM.EXCEPT MAYBE 1/4 OF IT OUT OF EVERY BAG..
