Medicredit Inc. and The Outsource Group have agreed to pay $5 million to settle a class action lawsuit alleging Medicredit recorded phone calls it made to cell phones without obtaining the recipients’ consent in violation of California’s Invasion of Privacy Act.

If you were in California and you were contacted by Medicredit on your cell phone between June 29, 2014 and Feb. 26, 2015, you may be entitled to payment from the Medicredit call recording class action settlement.

Plaintiff Sheena Raffin alleges Medicredit violated California’s Invasion of Privacy law by recording phone calls without the consent of the call recipient.

According to the California call recording class action lawsuit, California law prohibits one party to a phone call from intentionally recording the call without the knowledge or consent of the other party.

Raffin claims the defendants called her on her cell phone about an alleged debt and failed to disclose that the call was being recorded.

During this call, the parties discussed personal and sensitive information, including information about Raffin’s debt, the status of her pending litigation, and the nature of conversations she had with her lawyer, the Medicredit class action lawsuit says.

Raffin says she was unaware that the call would be recorded. According to the Medicredit class action lawsuit, there was no pre-call recorded message notifying her that the call was being recorded and the defendants’ representatives did not inform her that the call would be recorded.

Raffin claims that, despite California’s two-party consent rule, the defendants continue to violate the law by recording telephone conversations with California residents. Each violation may result in a statutory penalty of $5,000, the Medicredit class action lawsuit states.

The defendants deny the allegations but agreed to settle the Medicredit call recording class action settlement to avoid the uncertainty and expense associated with ongoing litigation.

The Medicredit class action settlement was preliminarily approved on May 11, 2018.

If you would like to opt out of or object to the Medicredit class action settlement, you must do so no later than Oct. 15, 2018.

Who’s Eligible

You are a Class Member of the Medicredit call recording settlement if the defendants’ records show that you were contacted on your cell phone for the first time by Medicredit between June 29, 2014 and Feb. 26, 2015 and you were physically present in California at the time of the call.

Potential Award

To be determined. The settlement fund will be distributed pro rata to Class Members who submitted a timely and valid Claim Form. The amount each claimant receives will depend on the total number of approved claims.

    Haven’t received a check. Apparently the amount is 4092.66. Apparently I had to send a letter to get another check sent since I never received one in March. They just told me the check date was pushed back after I waited 3 months. Something seems off hmmm…

    Update January 23, 2019:
    Class members who submitted timely, valid claims were mailed a W-9 Request Letter on January 23, 2019 in order to assist with issuing settlement payments. The due date to respond to the letter is February 13, 2019. Please read the letter carefully and follow the instructions. Settlement Awards are set to be mailed on March 4, 2019.
