UPDATE 5: On Dec. 2, 2020, Top Class Actions viewers started receiving checks in the mail worth up to $100 from the Lumber Liquidators flooring class action settlement. Congratulations to everyone who filed a valid claim and got PAID!

UPDATE 4: On September 4,2020, the District Court ordered the settlement administrator to proceed with the distribution of settlement benefits. According to the settlement website, payments and vouchers should be mailed by the end of 2020. Top Class Actions will let our viewers know as soon as we learn checks and vouchers are in the mail!

UPDATE 3: On March 10, 2020, the Fourth Circuit Court of Appeals affirmed the Lumber Liquidators Flooring Class Action Settlement. However, the District Court must now determine attorneys’ fees.  Claims will not be paid until the District Court issues a decision on the fees. Top Class Actions will continue to provide updates as they become available.

Lumber Liquidators has agreed to pay $36 million to settle multidistrict litigation involving allegations that some of its Chinese-made laminate flooring contained excessive levels of formaldehyde and that its flooring was not as durable as the company promised.

If you purchased Chinese-made laminate flooring sold by Lumber Liquidators between Jan. 1, 2009 and May 31, 2015, you may be entitled to benefits from the laminate flooring class action settlement.

The proposed Lumber Liquidators settlement will resolve two lawsuits, one of which alleged the Chinese-manufactured laminate flooring contained excessive formaldehyde levels and the other alleging the flooring failed to meet the industry standards for durability and scratch-resistance.

The plaintiffs claim that Chinese-made laminate flooring sold by Lumber Liquidators contained a dangerously high level of formaldehyde that made it unsuitable for use in a residence. They also claim that the flooring failed to properly adhere to the surface to which it was applied, causing it to buckle.

Lumber Liquidators was hit with more than 100 lawsuits following a March 2015 broadcast of “60 Minutes” that revealed Chinese-made laminate flooring sold by Lumber Liquidators allegedly contained six to seven times the amount of formaldehyde allowed under U.S. law.

Formaldehyde is a carcinogen, and exposure to the substance can cause headaches, nausea, and/or irritation of the eyes, nose and throat.

Lumber Liquidators denies the allegations but agreed to settle the laminate flooring class action lawsuit to avoid the expense and uncertainty of litigation.

The Lumber Liquidators laminate flooring settlement received preliminary approval in June 2018.

Class Members who would like to opt out of or object to the Lumber Liquidators settlement must do so no later than Sept. 4, 2018.

Who’s Eligible

You may be a Class Member of the Lumber Liquidators settlement if you are a person in the United States who purchased Chinese-made laminate flooring (that was labeled “Made in China”) from Lumber Liquidators between Jan. 1, 2009 and May 31, 2015.

Formaldehyde Class: Includes Class Members who purchased Chinese-made laminate flooring from Lumber Liquidators from Jan. 1, 2009 through Dec. 31, 2010.

Durability Class: Includes Class Members who purchased Chinese-made laminate flooring from Lumber Liquidators from Jan. 1, 2011 through May 31, 2015.

Potential Award

Varies, depending on whether you are a member of the Formaldehyde Class or the Durability Class.

Members of the Formaldehyde Class may receive a payment of up to $50 (depending on how many claims are approved) and Members of the Durability Class will be entitled to a portion of their purchase price, either paid in cash or a Lumber Liquidators voucher.

Class Members who belong to both the Formaldehyde Class and the Durability Class may submit claims for both benefits. NOTE: Settlement awards will be allocated on a pro rata basis depending on the total number of approved claims and the type of claims submitted.

Proof of Purchase

Class Members must provide documentation showing they purchased Chinese-made laminate flooring from Lumber Liquidators between Jan. 1, 2009 and May 31, 2015.

    I was head of class spent 1300 on flooring plus 175 on air test plus 250 on suits,mask,storing the floor we had just put down and had to pull back up. Awarded $72

    I think these lawyers are up to something sketchy. They are telling me they have no record of me filing a claim, and I KNOW I did. I do not delay with deadlines. They are asking me for proof that I submitted a claim on their website, which I never received. I saved the postcard and sent them a picture of it. They keep telling me they have no record of me submitting a claim. I follow directions very well (I’m a special ed teacher). I truly think these lawyers are the only ones that are going to make any money of this. The rest of us are stuck with the crappiest floor in history. So irriatting.

    I spent 2500.00 and have received nothing at all. Are checks still going out?? Is the time frame different for vouchers?

      Just received my voucher today, it states that if you selected the voucher you should receive about 52% of the purchase price. Hope that helps some you.

    Spent 2000 on flooring and got 25 bucks. Seems like a few people spent 2000 and got 200, what’s up with that?
