An $850,000 settlement has been proposed in a class action lawsuit accusing Centinela Feed Inc. of violating California wage and hour laws.

If you were employed by Centinela Feed in a non-exempt position in California at any time from March 12, 2011 through April 5, 2018, you may be entitled to benefits from the wage and hour class action settlement.

Plaintiff Edward Perez initially filed the Centinela Feed class action settlement in March 2015. He claims Centinela Feed failed to properly pay minimum wages and overtime wages, failed to provide compliant meal and rest breaks, failed to issue compliant wage statements, failed to reimburse business expenses, failed to pay all wages owed during employment at the time of termination, and other violations of California labor law.

California labor law protects employees’ rights to fair wages and proper working conditions. Employers who violate these laws may face hefty penalties and be required to compensate their employees for any California labor law violations.

Centinela Feed denies any wrongdoing and maintains it has complied with applicable state and federal labor laws. Although it does not admit liability, Centinela has agreed to settle the wage and hour lawsuit to avoid the burden and expense of ongoing litigation.

The Centinela Feed wage and hour settlement was preliminarily approved on April 5, 2018.

Class Members who would like to opt out of or object to the Centinela Feed settlement must do so no later than July 2, 2018.

Who’s Eligible

Class Members of the wage and hour settlement include anyone who was employed by Centinela Feed in a non-exempt position in California at any time from March 12, 2011 through April 5, 2018.

Potential Award

Varies.

Individual settlement payments will be calculated using this formula: 1) Dividing the net settlement fund (currently estimated to be $399,250) by the total number of hours worked by all participating Class Members and 2) multiplying the resulting amount by the total number of hours worked by the individual Class Member.

Proof of Purchase

None required. However, Class Members who wish to challenge the number of hours worked during the Class Period that are attributed to them must mail a written challenge to the Settlement Administrator, postmarked no later than July 2, 2018.

Claim Form Deadline

N/A. Class Members do not need to submit a Claim Form to receive benefits from the Centinela Feed settlement. Anyone who wishes to challenge the number of hours worked that are attributed to them in the settlement notice that was mailed to them must mail a written challenge to the Settlement Administrator, postmarked no later than July 2, 2018.
