Eddie Bauer has agreed to pay $300,000 to end a class action lawsuit alleging that the company recorded phone conversations with customers without their consent or knowledge. The Eddie Bauer class action claims the clothing chain violated California’s Invasion of Privacy Act (CIPA).

If you made a phone call to Eddie Bauer that was recorded without your permission between July 1, 2014 and Jan. 13, 2015 you may be entitled to benefits from the Eddie Bauer class action settlement. Class Members need to have been present in California when the call occurred.

Plaintiff Yevgeniya Granina alleged in her class action lawsuit that Eddie Bauer recorded phone calls made by consumers, but did not provide a warning or message about the recording prior to the phone call.

The Eddie Bauer class action lawsuit claimed that consumers disclosed sensitive information, including credit card numbers, addresses, and first and last names without knowing their information would be recorded. The plaintiff alleged that Eddie Bauer’s phone call recording policy violates the CIPA.

The Eddie Bauer class action was dismissed by a federal judge in December 2015, but was later revived when the plaintiff refiled the class action to establish claims under a different section of CIPA.

Eddie Bauer admits no liability, but agreed to pay up to $300,000 to settle the class action lawsuit. The retailer has also agreed to add a recording that will inform callers that their conversation will be recorded.

Class Members who want to be excluded from or object to the Eddie Bauer CIPA class action settlement must do so no later than March 22, 2018.

Who’s Eligible

Class Members include those who were physically present in California when they made a phone call to Eddie Bauer between July 1, 2014 and Jan. 13, 2015, and did not consent to the call being recorded.

Potential Award

The actual amount each Class Member receives will depend on the total number of claims filed. Each claimant will be entitled to an equal share of the settlement fund.

Class Members must provide the phone number(s) used to call Eddie Bauer.
