A $8.85 million Breyers settlement resolves claims the brand’s vanilla ice cream did not contain real vanilla as advertised.

The settlement benefits consumers who purchased any size of Breyers Natural Vanilla ice cream between April 21, 2016, and Aug. 14, 2024.

According to the class action lawsuit, Conopco Inc. falsely advertised Breyers ice cream as containing real vanilla derived from the vanilla plant. In reality, the ice cream allegedly contained vanilla flavoring that did not come from the plant.

Breyers is a popular ice cream brand sold in retailers around the country that comes in many flavors, including vanilla.

Breyers hasn’t admitted any wrongdoing but agreed to pay $8.85 million to resolve the false advertising class action lawsuit.

Under the terms of the Breyers settlement, class members can receive $1 per purchased product. Without proof of purchase, claimants may only claim up to eight products for a maximum payment of $8. With proof of purchase, class members can claim an unlimited number of documented purchases for much larger payments.

The deadline for exclusion and objection is Oct. 31, 2024.

The final approval hearing for the settlement is scheduled for Nov. 21, 2024.

To receive Breyers settlement benefits, class members must submit a valid claim form by Feb.19, 2025.
