Zales agreed to pay $7.54 million to resolve claims it violated the federal Telephone Consumer Protection Act (TCPA) by sending unsolicited telemarketing text messages.
The Zales settlement benefits individuals who did not provide their phone number to Zale Delaware Inc. (Zales) but received more than one text message within a 12-month period promoting Zales goods or services, where the person’s residential or cellular phone number had been registered with the National Do Not Call Registry for at least 30 days before receiving at least two text messages within the 12-month period.
The plaintiff in the class action lawsuit claims Zales sent unsolicited telemarketing text messages to consumers whose numbers were on the National Do Not Call Registry. The plaintiff says Zales violated the TCPA with these messages.
