
Grubhub agreed to a $7.15 million class action lawsuit settlement to resolve claims it added restaurants to its platform without permission.
The Grubhub settlement benefits businesses whose names or logos were used on Grubhub or any other part of the Grubhub platform, including AllMenus, Eat24, Seamless, Tapingo, LevelUp, OrderUp, MenuPages or BiteGrabber, from Jan. 1, 2019, through April 30, 2024, without a contract with Grubhub.
According to a class action lawsuit, Grubhub adds restaurants to its platform without permission. Plaintiffs in the case say this practice confuses consumers into thinking these restaurants have a partnership with Grubhub when they don’t, allegedly causing reputational harm and lost sales.
Grubhub is a food delivery app that allows consumers to order food from local restaurants. Grubhub also owns other delivery platforms, such as Seamless, Eat24 and more.
Grubhub has not admitted any wrongdoing but agreed to pay $7.15 million to resolve the allegations.
Under the terms of the Grubhub settlement, class members can receive a cash payment based on the length of time their business was listed on Grubhub without a contract.
All class members will receive an initial payment of $50. After these initial payments are distributed, class members will receive an additional payment that varies based on the length of time their business was listed on Grubhub. Businesses listed for longer periods of time will receive larger payments.
If funds remain in the settlement after the first distribution, class members may receive a second distribution. If there are not enough funds for a second distribution, the remaining funds will be donated to a charitable organization approved by the court.
The deadline for exclusion and objection is Feb. 2, 2026.
The final approval hearing for the food delivery app settlement is scheduled for April 15, 2026.
To receive settlement benefits, class members must submit a valid claim form by March 4, 2026.
Who’s Eligible
All businesses whose names or logos were used on Grubhub or any other part of the Grubhub platform, including AllMenus, Eat24, Seamless, Tapingo, LevelUp, OrderUp, MenuPages and BiteGrabber, from Jan. 1, 2019, through April 30, 2024, without a contract with Grubhub.
