UNITE HERE agreed to a $6 million class action lawsuit settlement to resolve claims it failed to prevent a 2023 data breach.
The UNITE HERE settlement benefits individuals whose private information may have been involved in the data breach on or around Oct. 20, 2023.
According to the data breach notification, the breach may have compromised names, social security numbers, financial account information, payment card data, health insurance information and other sensitive identifiers.
The class action lawsuit alleges that UNITE HERE failed to implement and follow basic security procedures and protocols, thus failing to comply with FTC guidelines and accepted industry standards, as well as violation of The New York Deceptive Trade Practices Act.
UNITE HERE is a labor union that represents hospitality, gaming, food service, airport, transportation and other workers. The union has not admitted wrongdoing but agreed to a $6 million class action settlement to resolve these allegations.
All class members of the UNITE HERE settlement can receive a cash payment and two years of free credit monitoring services regardless. Cash payments will vary depending on the number of participating class members.
Class members who experienced out-of-pocket expenses as a result of the data breach can receive up to $5,000 in reimbursement. This reimbursement covers bank fees, communication charges, travel expenses, credit monitoring services and other expenses. Class members must provide documentation of these expenses to receive reimbursement.
The deadline for exclusion and objection is April 11, 2025.
The final approval hearing for the UNITE HERE settlement is scheduled for May 12, 2025.
In order to receive settlement benefits, class members must submit a valid claim form by April 28, 2025.
Who’s Eligible
Individuals whose private information may have been compromised in the UNITE HERE data breach that occurred on or about Oct. 20, 2023.
Potential Award
A maximum of $5,000 in reimbursement for out-of-pocket expenses, a pro rata cash payment to all class members plus two-year credit services monitoring.
Proof of Purchase
Documentation to support out-of-pocket expenses such as credit card statements, bank statements, invoices, telephone records and receipts.
