A $6 million BMW settlement resolves claims the automotive company equipped certain vehicles with emissions defeat devices.
The settlement benefits drivers who owned or leased a 2009-2013 BMW X5 xDrive35d or 2009-2011 BMW 335d vehicle before Feb. 28, 2024.
According to the class action lawsuit, BMW equipped certain vehicles with defeat devices that reduced emissions in regulatory testing environments but turned off during regular operations. Consumers claim these devices financially harmed them because they would not have knowingly purchased a vehicle that failed to comply with emissions regulations.
BMW is a German luxury automotive manufacturer.
BMW hasnโt admitted any wrongdoing but agreed to pay $6 million to resolve the emissions class action lawsuit.
Under the terms of the BMW settlement, class members will receive a proportional share of the net settlement fund based on the amount of time they owned or leased their vehicles. Drivers who owned or leased their vehicles for longer will receive larger payments than those who owned or leased their vehicles for a shorter time. No payment estimates are available at this time.
If any unclaimed funds remain in the settlement due to uncashed checks or other factors, class members who accepted or cashed their initial checks may receive a second payment.
The deadline for exclusion and objection was Aug. 6, 2024.
The final approval hearing for the settlement is scheduled for Sept. 24, 2024.
To receive a BMW settlement payment, class members must submit a valid claim form by Dec. 18, 2024. Class members who wish to receive their settlement payments electronically must submit these requests by Nov. 20, 2024.
