TMX Finance agreed to a $6.5 million class action lawsuit settlement to resolve claims that it failed to prevent a 2022-2023 data breach that compromised consumer information.

The class action settlement benefits individuals whose personal information was compromised in the TMX Finance data breach between Feb. 3 and Feb. 14, 2023.

According to the data breach class action lawsuit, TMX Finance failed to protect consumer information accessed in 2023 that reportedly compromised sensitive information such as names, Social Security numbers, driver’s license numbers and financial account information.

TMX Finance is a financial services company that offers loans through several brands, including TitleMax, TitleBucks and InstaLoan.

TMX Finance has not admitted any wrongdoing but agreed to pay $6.5 million to resolve the data breach class action lawsuit.

Under the terms of the TMX Finance data breach settlement, class members can receive up to $35 for undocumented losses related to the data breach, such as time spent dealing with breach-related issues and emotional distress. Payments are subject to a $4.5 million cap and could be reduced on a pro rata basis.

Class members can also receive up to $500 for documented losses related to the data breach, such as identity theft, fraudulent charges and professional fees. Payments are subject to a $2 million cap and could be reduced on a pro rata basis.

Class members who do not file a claim will receive a one-time credit of $20 applied to any outstanding balance owed to TMX Finance. If a class member owes less than $20, their account will be reduced to $0.

The deadline for exclusion and objection is July 7, 2025.

The final approval hearing for the TMX Finance data breach settlement is scheduled for Aug. 12, 2025.

To receive settlement benefits, class members must submit a valid claim form by Aug. 6, 2025.


Who’s Eligible

TitleMax, TitleBucks, InstaLoan and other TMX customers whose personal information was accessed, stolen, impacted or compromised as a result of the TMX data breach announced in February 2023.

Potential Award

Up to $35 for undocumented expenses and up to $500 for documented losses. Alternative $20 payout.

Proof of Purchase

Receipts, bills, invoices, account statements, tax documents, police reports, identity theft reports, professional letters or other documentation.

    me someone said there going to pay on it and never did I didnt have the money to get it out a wreaking yard company and was always keep being harassed over it for a while and I told them where it was at and gave them the info I finely changed my phone number
