
Apria Healthcare has agreed to a class action lawsuit settlement for more than $6.3 million to resolve claims it failed to prevent a 2019 data breach that compromised its customers and employees’ personal information.
The settlement benefits individuals who received a notice from Apria Healthcare informing them that their information may have been compromised in a data breach in April 2019 and various dates thereafter.
The Apria Healthcare class action lawsuit claims the company failed to implement reasonable cybersecurity measures that could have prevented a data breach in April 2019. As a result of Apria’s alleged negligence, hackers were able to gain access to sensitive personal information, the plaintiffs contend.
Apria Healthcare is a home healthcare company that provides services such as oxygen therapy, sleep apnea treatment, wound care and more.
The company has not admitted any wrongdoing but agreed to this $6.375 million class action settlement to resolve the allegations.
Under the terms of the Apria Healthcare settlement, class members can receive reimbursement for out-of-pocket expenses related to the data breach. This includes unreimbursed fraud and identity theft losses, professional fees, credit expenses, credit monitoring costs, miscellaneous expenses and more. The settlement allows for up to $2,000 in reimbursement for these expenses.
Class members can also receive a pro rata cash payment from the settlement. These payments will vary depending on the number of participating class members and the amount of the settlement fund used for reimbursement.
The deadline for exclusion and objection is Sept. 22, 2025.
The final approval hearing for the Apria data breach settlement is scheduled for Nov. 4, 2025.
To receive settlement benefits, class members must submit a valid claim form by Oct. 22, 2025.
Who’s Eligible
Individuals who received actual or constructive notice from Apria that their information may have been compromised as a result of the illegal hacking events and/or as a result of prior unauthorized access to or disclosure of protected information.
Potential Award
Up to $2,000 for out-of-pocket losses or expenses, plus a pro rata cash payment.
Proof of Purchase
Receipts or other documentation not “self-prepared” by the claimant that documents the costs incurred. “Self-prepared” documents such as handwritten receipts are, by themselves, insufficient to receive reimbursement but can be considered to add clarity or support other submitted documentation.
