A settlement has been reached in a class action lawsuit filed by consumers who allege Sony sold VAIO Notebook computers with defective touchpads.
If you purchased a Sony VAIO laptop in California or New Jersey between March 16, 2006 and Jan. 4, 2017, you may be entitled to a cash payment from the class action settlement.
The Sony VAIO class action lawsuit was filed by plaintiffs Christina Egner and Rickey Glasco against Sony Electronics Inc. and Best Buy Stores LP. They allege Sony manufactured, marketed and sold VAIO Notebooks with defective trackpads (which are also known as touchpads).
According to the Sony VAIO class action lawsuit, the trackpad component was defective because it could cause the cursor on the screen to track in reverse, freeze, fail to register user input or operate erratically.
The plaintiffs asserted violations of the Consumers Legal Remedies Act, violation of the Unfair Competition Law, violation of the Magnuson-Moss Warranty Act, breach of express warranty, breach of the implied warranty of fitness for a particular purpose, breach of the implied warranty of merchantability, negligence, strict liability, and violation of the New Jersey Consumer Fraud Act.
In October 2013, a California judge granted Class certification to the VAIO settlement and certified a Class of California VAIO purchasers and a Class of New Jersey VAIO purchasers.
Sony denies the allegations but has agreed to settle the VAIO Notebook class action lawsuit to avoid the expense and uncertainty of ongoing litigation.
The VAIO trackpad class action settlement was preliminarily approved on Jan. 4, 2017.
The deadline to opt out of or object to the Sony VAIO class action settlement is June 5, 2017.
Who’s Eligible
Class Members of the Sony VAIO trackpad settlement include:
- California residents who purchased a Sony VAIO laptop, series SZ, FZ, NW, EB or F, in California between March 16, 2006 and Jan. 4, 2017; and
- New Jersey residents who purchased a Sony VAIO laptop, series SZ, FZ, NW, EB or F, in New Jersey between March 16, 2006 and Jan. 4, 2017.
Potential Award
Up to $200.
Sony has agreed to provide a one-time cash payment to Class Members who file timely and valid claims. The payments offered are as follows:
- 65 percent of documented out-of-pocket expenses incurred to repair the touchpad (up to a maximum of $200);
- 65 percent of documented out-of-pocket expenses incurred to purchase a peripheral workaround due to issues with the touchpad (up to a maximum of $60);
- $25 for Class Members who claim they experienced touchpad issues but do not have documentation about their expenses related to touchpad repair or the purchase of a peripheral workaround; or
- $5 for Class Members who do not meet the criteria to claim any of the above-listed benefits.
Proof of Purchase
To be eligible for benefits, Class Members may be asked to provide a proof of purchase code or other documentation showing proof of purchase or ownership of the VAIO Notebook.
Class Members who submit documentation of their out-of-pocket expenses to repair the touchpad or purchase a peripheral workaround will be entitled to a higher cash payout.
