CertainTeed Siding Class Action Settlement

If you owned a home, residence, building or other structure in the United States as of Sept. 30, 2013, on which specific CertainTeed products were installed on or before Sept. 30, 3013, you may be eligible to claim up to several thousand dollars from the class action settlement.

Who’s Eligible

Class Members include anyone who, as of Sept. 30, 2013, owned a home, residence, building or other structure in the United States as of Sept. 30, 2013, on which the following products were installed on or before Sept. 30, 2013:

  • CertainTeed Weatherboards Fiber Cement Siding
  • CertainTeed Lap Siding
  • CertainTeed Vertical Siding
  • CertainTeed Shapes
  • CertainTeed Soffit
  • CertainTeed Porch Ceiling
  • CertainTeed 7/16” Trim

CertainTeed’s vinyl siding and polymer shake products are not involved in this litigation.

Potential Award

Varies. Each Class Member who submits a valid Claim Form will be offered a cash payment based on a number of criteria, including (1) the extent of the Qualifying Damage; (2) the proportion of the wall with Qualifying Damage; (3) the size of the wall; (4) the length of time the siding has been installed; and (5) whether the Qualifying Damage was caused by a third party or as a result of improper installation or storage.

The amount of money you can receive from the CertainTeed class action settlement will be based in part on how long you have already been able to use the siding. Your award could be several thousands of dollars, according to the payment calculator outlined in the Settlement Notice.

Proof of Purchase

You must be able to prove that your CertainTeed siding meets the damage requirements set forth under the class action settlement agreement.

Case Name

In re: CertainTeed Fiber Cement Siding Litigation, Case No. 2:11-md-02270 in the U.S. District Court for the Eastern District of Pennsylvania.

Case Summary

If granted final approval, the CertainTeed siding settlement will resolve allegations that CertainTeed Corp. sold defective siding to thousands of customers and failed to adequately test and design its products before placing them on the market. Plaintiffs alleged that the siding products are subject to shrinkage, warping, cracking, bowing, delamination and other issues.

CertainTeed denies the allegations but has agreed to compensate consumers through a class action lawsuit settlement to resolve the litigation.

Each Class Member who submits a valid Claim Form will be offered a cash payment based on a number of criteria, including (1) the extent of the Qualifying Damage; (2) the proportion of the wall with Qualifying Damage; (3) the size of the wall; (4) the length of time the siding has been installed; and (5) whether the Qualifying Damage was caused by a third party or as a result of improper installation or storage.

The only way to receive a cash award is to submit a valid Claim Form by the deadline, which is six years after the Effective Date. The settlement will not become effective until the Court grants final approval to the deal. A Final Approval Hearing is set for Feb. 19, 2014.

    Got First Payment $5753.36, in 2015 Built home 2006, The balance to come 2020, Got Dear John Letter instead 2022!! Left me to suffer $11178.13 balance! The fiber cement siding was already going bad spring of 2007! had a hard time finding a Local Lawer to take it on, was told it No would be good money going after bad!! No man should pay for Certain Tees lack of Quality Control! Iam sending to the State for help! Cerian Tee has No Honor! This company shouldn’t be allowed in the State of Iowa!

    My certainteed fiber cement siding was installed 12/30/2013 and my neighbors later in 2014. Both have shrinkage, cracks, etc. The supplier must have known about the class action yet continued to sell to builders who installed after the class period dates. I need an attorney to pursue this beyond the class action. Homes are located in VA.

      Hi – did you find an attorney who was willing to represent you? I am having the same issue on siding that was installed in 2014 and cost to replace is not cheap.

    I had certainteed installed 5-6 yrs. ago instead of the Hardy siding. We chose Certainteed because of the variety of colors although the Hardy was recommended. Well, 3-4 yrs. ago our siding began to fade and crack especially on our South exposure that gets hot sun in the summer. We have multiple (20 or more) cracks. The finish is crackling, faded and is starting to get embarrassing. I was wondering if I was just expecting too much but, yes this product is not quality. I hope Certainteed does change their products after this.

    I emailed Certainteed several times complaining about the siding going back at least 5 years. The siding is okay that is under my Fiberglas decks but. the siding that is out in the open peels and has fissures in it. I also noticed that when I looked at the recenat installation instructions, They are quite different from when my siding was installed.I have the pre-painted Siding. I also emailed them in regard to my Hand Railings. The screws that attach the railing to the Posts, have severe rusting and are a Safety issue. I believe the new screws are Stanless Steel.       I live n a condo complex. Our siding project for 100 units was started in2012 and finished in 2013. My unit was
      resided in Dec. of 2012 when it was 5 above 0 . I had noticed in Apirl of 2013 that one side (the East side)
      has noticeable defects…. a 3″ split and warping and bowing plus some peeling. There have been 2 company
      reps who have looked at it and claim their product is not faulty!! (We now know it indeed is as there are
      several lawsuits claiming these very defects)
      The Home Owners Assn refuses to do anything about it, which I think is unfair and unjust….especially when
      I know that another condo complex just being built several blocks from here has had some of the same problems with Certainteed siding and they (the HOA at that complex) is doing the right thing and tearing off and residing and correcting the problem. Unfortunately I live in the wrong complex.
