McPherson Hospital in Kansas agreed to a class action lawsuit settlement to resolve claims it failed to protect consumers from a 2022 data breach.
The McPherson Hospital settlement benefits individuals whose private information hackers accessed during the McPherson Hospital data breach in July 2022.
The McPherson Hospital data breach allegedly compromised the sensitive information of 3,000 patients when a phishing email tricked an employee into providing their login credentials. Plaintiffs in the class action lawsuit claim McPherson Hospital should have done more to protect their information from hackers.
McPherson Hospital is a 25-bed critical access hospital in McPherson, Kansas.
McPherson Hospital hasn’t admitted any wrongdoing but agreed to pay $500,000 to resolve the data breach class action lawsuit.
Under the terms of the McPherson Hospital settlement, class members can receive up to $400 for ordinary expenses related to the data breach, such as bank fees and credit expenses, and up to three hours of lost time at a rate of $30 per hour. Class members who experienced extraordinary losses as a result of the data breach, such as fraudulent charges and identity theft damages, can receive additional reimbursement of up to $5,000 for these damages.
Claimants without documented losses or those who do not wish to claim reimbursement can instead receive an alternative cash payment of $75.
All class members can receive three years of free credit monitoring services through the settlement.
In addition to providing monetary benefits, McPherson Hospital agreed to make security enhancements, improvements to its policies and plans for future cybersecurity implementations.
The deadline for exclusion and objection was Dec. 30, 2024.
The final approval hearing for the McPherson Hospital data breach settlement is scheduled for Feb. 5, 2025.
To receive settlement benefits, class members must submit a valid claim form by Jan. 29, 2025.
