LoanCare agreed to pay $5.9 million as part of a class action lawsuit settlement to resolve claims it failed to prevent a 2023 data breach that compromised sensitive consumer information.

The LoanCare data breach settlement benefits individuals who received a data breach notice from LoanCare informing them their information may have been compromised in a cybersecurity incident on Nov. 19, 2023.

Plaintiffs in the class action lawsuit claim LoanCare could have prevented the 2023 data breach through reasonable cybersecurity measures. As a result of this alleged negligence, the

LoanCare data breach reportedly compromised sensitive information such as names, addresses, Social Security numbers and loan numbers.

LoanCare, a national subservicer of mortgage loans, hasn’t admitted any wrongdoing but agreed to a $5.9 million class action settlement to resolve these allegations.

Under the terms of the LoanCare settlement, class members can receive either reimbursement for documented expenses or losses or a flat-rate payment.

Reimbursement payments of up to $1,500 are available for ordinary losses such as credit monitoring services, fees, communication charges and other unreimbursed expenses. Class members can also claim up to $5,000 for extraordinary losses including unreimbursed fraud or identity theft damages. Both these claim categories need to be documented.

Class members who did not experience any losses as a result of the data breach, or who do not wish to claim reimbursable losses, can instead claim a flat-rate payment of $100. These payments may be increased or decreased on a pro rata basis.

All class members are eligible for three years of identity monitoring services. These services include real-time credit monitoring, dark web scanning, up to $1 million in identity theft insurance, access to fraud specialists and identity theft restoration services.

Class members who previously elected to receive 24 months of identity monitoring services offered by LoanCare will receive only one year of identity monitoring under this settlement.

The deadline for exclusion is July 7, 2025. The deadline for objection is Aug. 5, 2025.

The final approval hearing for the LoanCare data breach settlement is scheduled for Sept. 4, 2025.

To receive settlement benefits, class members must submit a valid claim form by June 4, 2025.


Who’s Eligible

Consumers who received a data breach notice from LoanCare informing them that their personal information may have been compromised in a cybersecurity incident that occurred in November 2023.

Potential Award

Between $100 and $6,500, including three years of identity monitoring.

Proof of Purchase

Documentation of data breach-related losses, such as bank statements, credit reports, invoices, bills, receipts, etc.
