PharMerica agreed to a $5.275 million class action lawsuit settlement to resolve claims it failed to prevent a 2023 data breach that compromised sensitive patient information.
The settlement benefits individuals who received a notice about the PharMerica data breach that occurred in March 2023.
PharMerica is a pharmacy company that provides services to long-term care facilities, senior living communities, hospitals, home health agencies, hospice, IDD and other settings. The company has more than 1,000 locations across the country.
In March 2023, PharMerica was reportedly the victim of a data breach that compromised sensitive patient information, such as Social Security numbers, health insurance data and more. The breach was allegedly the result of a ransomware attack from the cybercriminal group Money Message.
Affected consumers quickly took legal action against PharMerica, arguing that the company could have prevented the breach through reasonable cybersecurity measures.
PharMerica has not admitted any wrongdoing but agreed to settle the data breach class action lawsuit with a $5.275 million class action settlement.
Under the terms of the PharMerica settlement, class members can receive a cash payment for documented losses related to the data breach.
Class members can receive up to $10,000 for unreimbursed fraud or identity theft losses, professional fees, credit-related costs, credit monitoring expenses and other documented losses.
Class members who do not have documented losses can still receive a cash payment from the settlement. These class members will receive a proportional share of the net settlement fund based on the number of valid claims filed with the settlement.
All class members are eligible for one year of free credit monitoring through Kroll Complete Monitoring. This service includes credit monitoring, dark web monitoring, payday loan monitoring, Social Security scans, fraud consultation, identity theft restoration services, $1 million in fraud and identity theft insurance, credit score reporting and real-time inquiry alerts.
The deadline for exclusion and objection is April 13, 2026.
The final approval hearing for the PharMerica settlement is scheduled for May 12, 2026.
To receive settlement benefits, class members must submit a valid claim form by April 27, 2026.
Who’s Eligible
All individuals in the United States who were provided notice of the data incident.
Potential Award
Up to $10,000 in reimbursed losses or an alternative cash payment
Proof of Purchase
Documentation of losses other than self-prepared documents, such as handwritten receipts.
