
Boston Children’s Health Physicians (BCHP) agreed to a $5.15 million class action settlement to resolve claims it failed to prevent a 2024 data breach that compromised sensitive patient information.
The Boston Children’s Health Physicians settlement benefits individuals who were directly or indirectly notified by BCHP that their private information may have been compromised in the September 2024 data breach.
The BCHP data breach occurred in September 2024 and compromised the information of around 918,000 patients and employees. Plaintiffs in the data breach class action lawsuit claim BCHP could have prevented the breach through reasonable cybersecurity measures.
Boston Children’s Health Physician is a pediatric primary and specialty care group with 300 clinicians operating in New York and Connecticut.
BCHP has not admitted any wrongdoing but agreed to a $5.15 million settlement to resolve the data breach class action lawsuit.
Under the terms of the BCHP settlement, class members can receive a cash payment and two years of free medical data monitoring.
Class members can choose to receive either a documented loss payment of up to $5,000 or an undocumented loss payment of around $100. Undocumented loss payments may be increased or decreased depending on the number of claims filed. Payments for undocumented losses may be increased to $350 if there are not enough claims to exhaust the settlement fund.
Class members who choose to receive documented loss payments must provide proof of losses related to the BCHP data breach. These losses may include fraudulent charges, identity theft expenses, credit monitoring costs and more.
All class members are eligible for two years of free Cyex Medical Shield medical data monitoring. This service includes medical identity monitoring, real-time alerts and up to $1 million in identity theft insurance.
The deadline for exclusion and objection is Nov. 10, 2025.
The final approval hearing for the BCHP data breach settlement is scheduled for Dec. 10, 2025.
To receive settlement benefits, class members must submit a valid claim form by Nov. 25, 2025.
Who’s Eligible
Individuals who were directly or indirectly notified by Boston Children’s Health Physicians that their private information may have been impacted in the September 2024 data breach.
Potential Award
Up to $5,000 in documented losses or $100 in undocumented losses.
Proof of Purchase
Claimants seeking documented losses must submit receipts or other documentation that is not self-prepared.
