TreeHouse Foods agreed to a $4 million class action settlement to resolve claims it sold frozen waffles that were later recalled due to potential listeria contamination.

The TreeHouse frozen waffle recall settlement benefits consumers who purchased frozen waffles from one of the following brands between Oct. 18, 2024, and Sept. 2, 2025:

  • Always Save (Associated Wholesale Grocers – Independent Grocers)
  • Best Choice (Associated Wholesale Grocers – Independent Grocers)
  • Bettergoods (Walmart)
  • Breakfast Best (Aldi)
  • Clover Valley (Dollar General)
  • Compliments (Sobeys / Safeway / FreshCo / Foodland – Canada)
  • Essentials (Smart & Final)
  • Food Lion (Ahold Delhaize USA – Food Lion Stores)
  • Foodhold (Ahold Delhaize USA – Giant, Stop & Shop, The Giant Company)
  • Giant Eagle (Giant Eagle / Market District)
  • Good & Gather (Target)
  • Great Value (Walmart)
  • Hannaford (Ahold Delhaize USA – Hannaford Supermarkets)
    Harris Teeter (The Kroger Co.)
  • H-E-B Higher Harvest (H-E-B)

According to the class action lawsuit, TreeHouse Foods failed to warn consumers about the risk of listeria contamination before it issued the frozen waffle recall. Consumers claim they were harmed by the company’s negligence and were forced to throw away the contaminated products.

TreeHouse Foods is a food and beverage manufacturer that sells products to grocery stores and restaurants. In October 2024, the company recalled several frozen breakfast products due to potential listeria contamination.

TreeHouse has not admitted any wrongdoing but agreed to pay $4 million to resolve the allegations.

Under the terms of the frozen waffle recall settlement, class members can receive a cash payment for the purchase of covered products.

  • Class members who have proof of purchase can receive a full refund for the products they purchased.
  • Class members without proof of purchase can receive an average retail price for up to two covered products per household.

If a class member already received reimbursement from TreeHouse Foods for the recalled products, their settlement payment will be reduced by the amount of reimbursement they received.

The deadline for exclusion and objection is Dec. 16, 2025.

The final approval hearing for the frozen waffle recall settlement will be set at the Dec. 12, 2025

status conference.

To receive class action settlement benefits, class members must submit a valid claim form by Dec. 16, 2025.
