TalentBin FCRA settlement

A settlement has been reached in a class action lawsuit alleging TalentBin Inc. acted as a “consumer reporting agency” that prepared “consumer reports” according to the Fair Credit Reporting Act (FCRA) when it gathered information from various online sources about job seekers and compiled the data into “candidate information” that could be purchased by recruiters and potential employers.

If you had a TalentBin candidate profile created about you between Oct. 2, 2013 and Aug. 8, 2016, and the profile was exported to a recruiter or potential employer, you may be entitled to compensation from the TalentBin class action settlement.

The TalentBin class action lawsuit was filed by several people who allege they had TalentBin candidate profiles created about them. However, they claim that these profiles were handled in such a way that did not comply with the requirements of FCRA.

“Notably, most consumers do not sign up to have their information featured on Defendant’s website,” the TalentBin class action lawsuit states. “While consumers who choose to do so can submit information for inclusion in their profile, Defendant’s regular business practice is to create profiles on consumers and sell them, without the consumer having done anything to invite or initiate a relationship with Defendant.”

According to the TalentBin class action lawsuit, these practices mean that TalentBin is classified as a “credit reporting agency” that prepares “consumer reports,” as defined in the FCRA. The plaintiffs allege TalentBin violated the FCRA in several ways, including:

  • Failing to obtain certifications from users of TalentBin’s system that the use is for a “permissible purpose” under the FCRA;
  • Failing to obtain certifications from users who used the candidate profiles for “employment purposes” as defined by the FCRA that the user will comply with the FCRA;
  • Failing to provide users with a summary of consumers’ rights as set forth by FCRA;
  • Failing to provide notice of users’ obligations under FCRA; and
  • Failing, upon request, to provide consumers with copies of TalentBin’s files about the consumers, including the sources of information in the profiles and to whom those profiles were provided.

TalentBin denies that it is a “consumer reporting agency” under the Fair Credit Reporting Act and that the candidate profiles are not “consumer reports,” and that the FCRA does not apply to the company or its practices. However, the company has agreed to settle the candidate profile class action lawsuit to avoid the expense and uncertainty of litigation.

Under the terms of the proposed FCRA class action settlement, TalentBin will pay $1.15 million to resolve the litigation. The TalentBin settlement was preliminarily approved on Jan. 27, 2017.

Class Members who would like to opt out of the FCRA settlement must do so by April 10, 2017. If you would like to object to the TalentBin class action settlement, you must do so no later than May 1, 2017.

Who’s Eligible

Class Members of the FCRA settlement include anyone who was the subject of a TalentBin candidate profile who either requested a copy of their candidate profile or were the subject of such a profile that was exported to a recruiter or potential employer between Oct. 2, 2013 and Aug. 8, 2016.

Potential Award

$100 – $500. The actual amount each Class Member will receive depends on the total number of claims filed.

    The thing with talentbin, is that you don’t create a profile on their site, Talentbin can just search across different site and create a profile on you, without your knowledge.
    So how do you even know if they created a profile on you or not.

    I remember creating a profile with said company but I have a different e- mail address, so I do not know if I received an e- mail from you with a PIN number (I can no longer retrieve e- mails from previous addresses). My previous e-mail addresses are:

      Maybe you should invest some money in education. This is a website that shows class actions. It does not handle the claim.
