
Capital Health has agreed to a $4.5 million class action lawsuit settlement to resolve claims that it failed to protect consumers from a 2023 data breach.
The Capital Health settlement benefits individuals whose private information was potentially compromised in the Capital Health data breach between Nov. 11 and Nov. 26, 2023.
The Capital Health data breach allegedly compromised sensitive information such as Social Security numbers, clinical information, email addresses and more. According to plaintiffs in the class action lawsuit resolved by this settlement, the breach could have been prevented if Capital Health had taken reasonable cybersecurity measures.
Capital Health is a health system in New Jersey and Pennsylvania that offers a range of services including emergency care, cancer treatment and more.
The company has not admitted any wrongdoing but agreed to a $4.5 million class action lawsuit settlement to resolve these allegations.
Under the terms of the Capital Health settlement, class members can receive either documented or undocumented losses.
Class members who experienced documented losses as a result of the Capital Health data breach can receive up to $5,000 in reimbursement. These losses may include, but are not limited to, identity theft, fraud, credit monitoring expenses, professional fees and more.
Class members who did not experience documented losses can receive a flat payment of $100.
All class members, regardless of whether they experienced documented or undocumented losses, can receive three years of free credit monitoring. This benefit is valued at $90 per year.
Payments may be subject to pro rata adjustments depending on the number of claims filed with the settlement.
The deadline for exclusion and objection is March 9, 2026.
The final approval hearing for the Capital Health settlement is scheduled for July 14, 2026.
To receive settlement benefits, class members must submit a valid claim form by April 6, 2026.
Who’s Eligible
Individuals whose personal information was compromised or potentially compromised in the Capital Health data breach that occurred between Nov. 11 and Nov. 26, 2023.
Potential Award
Up to $5,000 in documented losses or a $100 alternative cash payment, plus three years of credit monitoring.
Proof of Purchase
Documentation of their losses, such as receipts or bank statements. Self-prepared documents are not sufficient.
