United Dominion Realty agreed to a $3 million class action lawsuit settlement to resolve claims it charged California tenants unlawful late fees.
The United Dominion Realty settlement benefits California residential tenants who were charged or paid one or more late fees by United Dominion Realty between Aug. 12, 2017, and Oct. 24, 2024.
Plaintiffs in the class action lawsuit accused United Dominion Realty of charging unfair late fees on rent payments. Although United Dominion outlined the late fees in its rental agreements, these $100 charges allegedly violated California law.
United Dominion Realty is a real estate investment trust that owns and operates rental properties across the country.
United Dominion hasn’t admitted any wrongdoing but agreed to the $3 million settlement to resolve the late fee class action lawsuit.
Under the terms of the United Dominion Realty settlement, class members can receive a cash payment. Payments will vary depending on the number of United Dominion late fees each class member was charged during the class period. No payment estimates are available at this time.
Current tenants, defined as United Dominion tenants as of Oct. 24, 2024, will automatically receive a settlement payment at their current address. Former tenants are also eligible for payments but will not receive them automatically.
The deadline for exclusion and objection is March 3, 2025.
The final approval hearing for the settlement is scheduled for April 2, 2025.
Current tenants do not need to file a claim to receive their settlement payment. Former tenants must submit a valid claim form by March 3, 2025, to receive settlement benefits.
