A settlement has been reached in a class action lawsuit alleging that certain people who worked for Verizon or Frontier in West Virginia experienced discrimination due to their disabilities.

If you worked for Verizon or Frontier in the consumer sales and service Call Centers located in Clarksburg and/or Charleston, W. Va., between July 20, 2009 and Nov. 9, 2016, and you had a disability during that time period, you may be entitled to compensation from the disability discrimination class action settlement.

Plaintiffs Trecia Marie Moore, Kimberly Ann Davis and Laura J. Martin filed the disability discrimination class action lawsuit against Verizon West Virginia Inc., Verizon Services Corp., Verizon Communications Inc., Frontier West Virginia Inc., and other defendants in July 2011.

They accused the defendants of violating the West Virginia Human Rights Act by discriminating against employees who were disabled (or perceived as disabled).

The plaintiffs allege that the defendants targeted disabled employees for discriminatory treatment, failed to grant reasonable accommodations as required by law, failed to engage in a dialogue as required by law and targeted disabled employees for disparate treatment.

The plaintiffs also assert that the defendants “disseminated and published personal and confidential medical information” about some of the plaintiffs in violation of state law.

The West Virginia Human Rights Act defines a disability as a mental or physical impairment that substantially limits one or more major life activities such as caring for oneself, walking, seeing, hearing speaking, breathing, learning, working, and performing manual tasks.

The defendants deny the allegations but agreed to settle the disability discrimination class action lawsuit to avoid the burden and expense of litigation.

Class Members who would like to opt out of or object to the West Virginia disability discrimination settlement must do so no later than Jan. 23, 2017.

Who’s Eligible

“The Settlement Class includes all present or former employees of Verizon and/or Frontier who worked as consultants or clerks in a Call Center at 425 South Holden Street, Clarksburg, West Virginia 26301 and/or 1500 MacCorkle Avenue, South East, Charleston, West Virginia 25314, between July 20, 2009 and November 9, 2016, and who at any time during that period had a Disability and were subject to discriminatory treatment or a hostile workplace because of their Disability.”

Potential Award

Up to $15,000.

The amount Class Members will receive depends on whether they submit a claim for Pool A or Pool B, and the total number of claims filed.

Class Members who file a Pool A claim may receive a settlement payment of up to $15,000. Class Members who file a Pool B claim may receive a payment of up to $2,000.

Proof of Purchase

N/A. Class Members who file claims for the West Virginia disability settlement must provide all required documentation with their Claim Form. The Claim Form must be notarized.
