Smitty’s Supply and CAM2 International agreed to pay $31.9 million to resolve claims that their tractor hydraulic fluid damages equipment.

The Smitty’s Supply and CAM2 settlement benefits consumers who purchased Super S Super Trac 303 Tractor Hydraulic Fluid, Super S 303 Tractor Hydraulic Fluid, CAM2 ProMax 303 Tractor Hydraulic Oil and/or CAM2 303 Tractor Hydraulic Oil since Dec. 1, 2013.

Those who purchased Super S Super Trac 303 Tractor Hydraulic Fluid in Missouri are excluded from the settlement.

According to the class action lawsuit, Smitty’s Supply and CAM2 tractor hydraulic fluid products do not meet equipment 303 THF specifications despite being advertised as such. Consumers claim these advertisements misled them so they used them in their machines, leading to engine damage.

Smitty’s Supply and CAM2 International are manufacturers of automotive and agricultural fluids, including tractor hydraulic fluid.

The defendants haven’t admitted any wrongdoing but agreed to the $31.9 million class action settlement to resolve these allegations. They also agreed to a separate settlement benefiting retail customers who purchased from certain retailers.

Under the terms of the Smitty’s Supply and CAM2 settlement, class members can receive a cash payment based on the number and size of products they purchased.

Purchasers of five-gallon buckets can receive $12. Those who purchased two-gallon jugs can receive $6, those who purchased one-gallon jugs can receive $4. Purchasers of 55-gallon drums can receive $90. Based on these payments, class members can receive up to $100 for product purchases without proof of purchase. Higher payments are available with proof of purchase.

Class members who experienced repairs, parts purchases or specific equipment damage related to their use of Smitty’s Supply and CAM2 International tractor hydraulic fluid can receive additional payments of up to $1,000. These payments include funds for flushing the hydraulic systems of affected equipment.

If any additional funds remain in the settlement after paying purchase and repair claims, class members may receive a pro rata share of the remaining funds based on their total claim value. 

Similarly, if the $31.9 million settlement fund cannot cover all of the filed claims, payments will be reduced on a pro rata basis.

The deadline for exclusion and objection is March 1, 2025.

The final approval hearing for the settlement is scheduled for March 26, 2025.

To receive settlement benefits, class members must submit a valid claim form by March 1, 2025.

Consumers and entities who purchased Super S Super Trac 303 Tractor Hydraulic Fluid, Super S 303 Tractor Hydraulic Fluid, CAM2 ProMax 303 Tractor Hydraulic Oil and/or CAM2 303 Tractor Hydraulic Oil in the United States between Dec. 1, 2013, and the present, excluding Missouri purchases of Super S Super Trac 303
