Kaye-Smith Enterprises Inc. agreed to pay $2 million to resolve a data breach class action lawsuit.

The Kaye-Smith Enterprises settlement benefits individuals whose personal information was compromised in the data breach, which the company discovered in June 2022.

The settlement also benefits businesses that suffered from financial losses related to the Kaye-Smith data breach.

The Kaye-Smith data breach class action claims the incident compromised the sensitive information of both individual consumers and business entities. It also alleges Kaye-Smith failed to protect this sensitive information and notify those affected by the breach in a timely manner.

Kaye-Smith Enterprises is a data-driven marketing company that provides services such as direct mail, email, digital and mobile marketing, data processing and more.

The company has not admitted any wrongdoing but agreed to the $2 million settlement to resolve the Kaye-Smith data breach class action lawsuit.

Under the terms of the Kaye-Smith Enterprises settlement, consumers who file a claim can receive reimbursement for documented expenses or an alternative payment.

Tier 1 claimants who spent time and money mitigating the data breach can receive up to $2,500 for documented losses, such as credit monitoring, identity theft expenses, fraudulent charges and more. This includes up to five hours of lost time at $25 per hour and your documented out-of-pocket expenses. Tier 2 claimants who took any action at all in response to the data breach can receive a $500 alternative payment.

All claimants can receive 12 months of free credit monitoring services from CyEx. 

Businesses can also receive reimbursement for data breach-related losses under slightly different terms. Business loss reimbursement is not capped but has the potential to be higher or lower depending on the number of consumer claims filed and the amount left in the settlement fund after those claims are paid.

In addition to providing monetary benefits, Kaye-Smith agreed to change its business and cybersecurity practices to better protect client and consumer data.

The exclusion deadline was Dec. 2, 2024. The objection deadline is Dec. 26, 2024.

The final approval hearing is scheduled for Jan. 7, 2025.

The claim form deadline is Dec. 26, 2024.
