Eskenazi Health agreed to a $2.5 million class action lawsuit settlement to resolve claims it failed to prevent a 2021 data breach that compromised sensitive employee and patient information.

The settlement benefits individuals whom Eskenazi Health sent a written notification that hackers posted their personal information on the dark web following a data breach that occurred on or around May 19, 2021.

According to the data breach announcement, hackers gained access to Eskenazi Health’s network on or around May 19, 2021, and accessed sensitive data, including names, addresses, birth dates, Social Security numbers, health insurance information, medical record numbers and driver’s license numbers. According to the class action lawsuit, Eskenazi Health could have prevented the data breach by implementing reasonable cybersecurity measures to protect consumer information. Eskenazi Health allegedly informed patients of the data breach on Nov. 11, 2021.

Eskenazi Health is a health system based in Indianapolis.

Eskenazi Health hasn’t admitted any wrongdoing but agreed to pay $2.5 million to resolve the data breach class action lawsuit.

Under the terms of the Eskenazi Health settlement, class members can receive reimbursement for out-of-pocket expenses and lost time.

Class members can receive up to $5,000 for out-of-pocket data breach-related losses, such as bank fees, communication charges, travel expenses, credit-related costs and more. Class members can also receive up to four hours of lost time at a rate of $20 per hour for a total of $80 in lost-time payments.

Class members are also eligible for pro rata payments from the settlement fund. These payments will vary depending on the number of claims filed with the settlement. No payment estimates are available at this time. Class members can receive both reimbursement and pro rata payments from the settlement.

In addition to monetary benefits, the settlement also provides three years of credit monitoring and identity theft protection services. These services include $1 million in identity theft insurance.

The deadline for exclusion and objection was Sept. 30, 2024.

The final approval hearing for the Eskenazi Health data breach settlement was scheduled for Nov. 4, 2024.

To receive settlement benefits, class members must submit a valid claim form by Jan. 27, 2025.

    I need someone to contact me regarding the eskenazi lawsuit. I just saw this and I was a patient there for years and also wishard hospital before it was called eskenazi. I never knew about this but I moved from Indianapolis to Martinsville. I’m sitting here with several other data breach letters I get in the mail. Like change healthcare. .community health network out of Indianapolis. But I also have letters from at& t. . IHA indianapolis housing agency…and zeroed in technologies.

    It would be nice if a lawyer would reach out to me in this department because I have five letters sent to me Three of them are from companies that released all my medical and personal information and two are from companies that released all my personal information, extremely personal information but the ones that release that and my health information really bugs me. They failed to let me know for over a year even though they already knew and they didn’t report it to the cops on one of them and on the other one they waited six months before reporting into anybody or the cops and the other three it took them a couple months. ., literally everything you could think of data wise about me including all my health stuff is now all over the black web. It would be really nice to have a lawyer who could handle these cases actually reach out to me. And on my credit report I have three more companies that have been releasing information that they shouldn’t have, I have never used these companies but yet they have only information and releasing it online during breaches. So I have proof of all this I just need a lawyer.
